| BOPEE scam: Court reserves orders on bail plea of accused | | | S Sabaqat Srinagar, Dec 4 : Court of Special Judge Anti-Corruption Kashmir today court reserved its orders on the bail application moved by Sajjad Ahmad, one of the accused in a scam involving selling of papers of Common Entrance Test last year, conducted by the Board of Professional Entrance Examinations (BOPEE). After hearing both sides, the Special Judge Anti-Corruption Kashmir, Mohan Lal Manhas reserved the orders to be pronounced on November 10. The CPO (Chief Prosecution Officer) argued in the court that there is "well found" evidence against Sajjad, a resident of Kulgam who has allegedly worked as tout in distribution of CET-2012 and to its sharp contrast counsel Mushtaq Ahmad Dar appearing for the bail petitioner contented the Crime Branch in support of the bail to his clients. "The investigation conducted so far has revealed that the applicant has been a close associate of Farooq Ahmad Itoo a kingpin of the racket," the Crime Branch had said. "Sajjad, according to crime Branch, has received question papers of Physics, Chemistry and Biology from another accused 'Itoo' at Nishat in outskirts of Srinagar and then he distributed it among various candidates through one Haroon Rashid of Dayalgam Anantnag . "The applicant has received huge amount from Haroon Rashid and others and thereafter provided them the question papers. Out of this amount, a portion was paid to Farooq Ahmad Itoo," he said, seeking dismissal of the bail application. Meanwhile, the Crime Branch said it has powers to investigate the scam, rejecting the contention by former chairman of the BOPEE that it was vigilance organization and not the CB which has hold the probe under 5(2) of Prevention of Corruption Act. "Under the SRO-202, the Crime Branch can investigate all those cases which may be referred to it by the government or Director General of Police from time to time," CPO Crime Branch said. However, advocate Abdullah Pandit, counsel appearing for Peer, defended that the investigation agency has no authority to investigate the case under 5 (2) of Prevention of Corruption Act. He also referred to Supreme Court and High Court judgments in support of his arguments. However, the as the CPO sought to contended him, he urged the court to defer the arguments for Monday. The court accepted the prayer and posted it for arguments on Monday. Regarding health status of Mushtaq Ahmad Peer, the CPO -CB said he is healthier than anybody else. "He is being regularly taken for check up. They are alleging that he is a cardiac patient but he is fit," he said, adding, "In fact, he has made people heart patient in the Valley. "The CPO said that Peer is an influential person which can be depicted from the fact that he has been granted extensions after extensions in his services. Here it needs to mention that the former BOPEE chairman was arrested on the basis of statements recorded from the brokers, students and their parents on October 23. |
