2 awarded lifer for murder

Jammu, Dec 26 : Principal Sessions Judge Kathua AK Koul today awarded life-imprisonment and fine Rs 10,000 each to Sanjeev Kumar S/o Bal Krishan and Raj Kumar alias Raju S/o Karam Chand Both residents of Bagyal Tehsil and District Kathua who were facing trial in murder case for the last five years. According to the police, on 26.9.2008, there was a tiff between one Harbans Singh deceased and the father of Sanjeev Kumar on account of a land dispute.
This annoyed the accused and they waylaid deceased at about 4.30 p.m on the same day, restrained him wrongfully, and in furtherance of common intention they attacked the deceased with intention to kill him, with a "Darat" (sharp cutting weapon) held by Sanjeev Kumar, on his neck repeatedly.
Accused No.2 caught hold of the deceased and Sanjeev Kumar launched the assault. An alarm was raised when some people came on spot but accused managed to escape. The deceased was shifted to hospital in a seriously injured condition. The deceased remained hospitalized in GMC Jammu from 26.9.2008 to 7.10.2008, during which time he was declared unfit for giving his statement. On October 7, 2010 he was shifted to PGI Chandigarh where he succumbed to his injuries on 8.10.2008 and after completion of investigation challan was presented in the Court.
The learned judge after hearing YC Katooch, Advocate for accused persons whereas Ravi Gupta Public Prosecutor for the state, observed that this Court of the considered view that the material on record is sufficient enough to create a doubt free link between the accused and the guilt.
So both the accused are convicted U/S 302/341/34 RPC and further observed that ends of justice would be met with if the accused are awarded the minimum punishment prescribed for the crime committed by them. So while convicting the accused for commission of offences u/s 302/341/34 RPC, I sentence each of them to imprisonment for life and a fine of Rs.10,000/- for commission of offence u/s 302 RPC. Each of the accused is also sentenced to imprisonment for one month for commission of offence u/s 341 RPC.
In case of default in payment of fine, the accused shall undergo an imprisonment for a further period of one month. All the sentences would run concurrently. JNF
