| HC asks CS to provide funds for removal of waste from psychiatric hospital | | | Early Times Report srinagar, Dec 26: A Division Bench of Jammu and Kashmir High Court has asked Chief Secretary of the state to make funds available for the procurement of Dumper Placer in Psychiatric Hospital for the removal of solid waste on daily basis from the hospital. Hearing a Public Interest Litigation, the division bench comprising Justice MH Attar and Justice Tashi Rabstan passed the direction after Medical Superintendent Psychiatric Hospital in its status report stated that the Director, State Motor Garages, has asked the Health Department for making advance payment of Rs. 3.78 lacs for the purchase of the Dumper Placer. "In order to ensure compliance of the statute, solid waste is to be removed on daily basis. The Chief Secretary of the state, shall ensure forthwith that steps, for making available the requisite amount to the Director State Motor Garages, to ensure that the Dumper Placer for garbage bins is purchased and kept at the hospital disposal of the authorities for Psychiatric Disease Hospital Srinagar," the court said directed. On last date of hearing, the court had directed the respondents to take immediate, steps for procurement of the said dumper bin vehicle amid the direction that they must ensure that the arrangements are made for removal of Bio-Medical waste as well as solid domestic waste on daily basis in tune with the rule requirement. In another direction, the Division Bench also directed Commissioner Srinagar Municipal Corporation to appear in persons on next date of hearing to inform the court about the status of construction of quarters/flats for the families of the lepers at Lal Bazar here. On this occasion, Senior AAG J A Kawoosa, standing counsel for SMC F A Mir and advocate J Iqbal submitted that they will personally visit the Leper Home and the Psychiatric Hospital, and report to the Court, the conditions prevailing there. "The concerned authorities shall render all necessary assistance to the learned counsel for the said purpose," the division bench said directed while hearing a Public Interest Litigation titled G M Khan versus state. In the status report about the staff strength and vacancies in the hospital, the Government informed the court that vacancies could not be filed due to the non-availability of eligible candidates. "It has been decided that to get the doctors having prescribed qualification from State Health department for their posting in the psychiatric hospital on deputation basis," AAG JA Kawoosa told the court. On last date of hearing, the Government had informed the court that the despite extension of time for submission of applications, no one has applied up to 30.11.2013, which was last data for receipt the applicants. Later the respondents decided to extend time by further 15 days. "The respondents shall be at liberty to do but at the same time if again response will be poor, in that eventuality they shall come up with a concrete proposal for filling up such posts by other permissible modes," the court had said. |
