| Court awards 10 years RI in murder case | | | Et Report Jammu, Feb 10 : First Additional Sessions Judge Jammu YP Bourney today awarded 10 years rigorous imprisonment and fine Rs 25000/- to Harvinder Singh s/o Inderjit Singh r/o Bohar Camp Jammu who killed Onkar Singh on dispute. According to prosecution case that on July 17, 2006 complainant Pawan Deep Singh lodged an oral report at PP Gadigarh Jammu that his maternal uncle Onkar Singh was having a land dispute with the accused and so their relations were on inimical and on the same day at about 7;00 PM he was standing near house of deceased when accused armed with axe and with intention to murder start inflicting Onakar Singh and got critically injured. Police registered a case u/s 307 RPC but deceased succumbed to injures the case converted 307 RPC to 302 RPC and presented challan. After hearing APP Harpal Singh for the state whereas Adv Rakesh Sharma appearing for the accused, 1st Additional Sessions Judge Jammu YP Bourney observed that the offence for which offender has been convicted and was admittedly no premeditated and preplanned but occurrence at the heat of moment due to the grave and sudden provocation for which deceased himself was to be blamed since he wanted to prepare dinner at convict's place when their relations were already in trouble. However the manner in which the offence has been committed clearly proves that he intended to commit culpable homicide as he inflicted axe-blows repeatedly over vital part of body and awarde3d 10 years RI and fine Rs 25000/- sent the accused to Central Jail for serving the sentence.
