HC directs closure of illegal tuition centres in Kashmir | | | Early Times Report
Srinagar, Dec 30: Terming conversion of teaching profession into commercial activity by some teachers as "unfortunate", a Division Bench of Jammu and Kashmir High Court today directed closure of all unregistered coaching and tuition centres across Kashmir division. The directions were passed by the Division Bench comprising Justice M H Attar and Justice A M Magrey while hearing a Public Interest Litigation, seeking a check on 'mushrooming' of private coaching centres in Kashmir Valley. The Division Bench also directed constitution of a three member committee comprising Divisional Commissioner Kashmir, Director School Education Kashmir and Inspector General of Police, Kashmir. The committee, Division Bench said, shall be headed by the Divisional Commissioner. It was directed to be formed there is presently no monitoring committee in place as required in terms of Jammu & Kashmir Regulation of Private Tuition Centres Rules of 2010. "The Committee shall forthwith close down all unregistered tuition and coaching centres wherever functioning in the Kashmir Division," the Division Bench said. It also directed the committee to ensure police personnel are kept on duty in the areas where the coaching centres are located and functioning. The Division Bench also asked Committee to direct all the Deputy Commissioners of Kashmir Division to visit all the tuition, coaching centres along with Chief Education Officers of respective districts and find out as to whether appropriate facilities, in terms of Rules of 2010, are being provided to the students. The Division Bench said committee shall also ensure that all the registered tuition coaching centres provide free admission upto 10% of their total intake capacity in each class, course for the students, who happen to be destitute, orphans or who belong to the families living Below the Poverty Line. The Division Bench also directed the owners of tuition centres, coaching centres to take necessary steps in maintaining moral values in and around institutions. It also directed installation of Close Circuit TVs outside the coaching centres. "It is further provided that any untoward incident which may happen within the premises of the tuition , coaching centres or in their close vicinity will make the owners, managers of the tuition centres/coaching centres liable of the legal action, which will be initiated against them including closing down of the tuition centres/coaching centres," the Division Bench said. The PIL filed by one Ahsan Untoo seeks directions for closing down of all illegal and unregistered Private Tuition Centres across the Valley. The PIL also seeks cancellation of registration of Private Tuition Centres who do not conform to the rules in vague, particularly displaying and notifying monthly tuition fee or charge exorbitant tuition fee. The PIL also seeks directions to maintain prescribed teacher student ratio vis-à-vis jam packed classes. "The students are crouched like animals irrespective of gender, male or female." It also seeks directions to ensure basic infrastructure like adequate heating and cooling arrangements, separate wash rooms, drinking water facility, congestion free area, comfortable seating arrangement and providing of minimum covered area or space of 9 square feet per candidate in the tuition centres. |
