Death penalty to two in Chopra Murder case | | | Early Times Report
Jammu, Feb 11 (JNF): Principal Sessions Judge Jammu RS Jain today in historical judgment awarded death sentence to Sangram Pardhi and Nanju present in much publicized chopra murder case. After hearing Adv Ashwani Khajuria, Principal Sessions Judge Jammu RS Jain observed that there is extensive premeditation and planning of both that they entered the house of deceased Rajinder Bhushan Chopra and killed vulnerable persons including a housewife and young girl. Court observed that the horror of what happened is all too apparent and murders of five persons in one go reflects maniacal nature and disregard of the accused for human life. Principal Sessions Judge RS Jain further observed that both of the accused had come all the way from Madhya Pradesh to Jammu having done your planning to commit offence and if during the commission of offence, there would be a need to kill people, it would be done and so, you had no qualm in taking out the life out of five persons. No sentence this Court can pass will ease that pain of the three families. Court further observed that this Court is constrained to hold that the mitigating circumstances, elaborated upon by the defence fade into insignificance in the light of the aggravating circumstances and the instant case without a shadow of doubt falls in the category of the rarest of rare cases where culpability has assumed the proportion of extreme depravity and lack of respect for human life. The medical evidence and photographs says it all. While on the photographs of the victims, Court is of the view that even in death, the victims are entitled to dignity. Accordingly, the photographs be put in a sealed cover to be opened with the permission of the Superior Court. With the observations Principal Sessions Judge Jammu RS Jain held that accused Sangram Pardhi is sentenced to death for offence u/s 302/120-B RPC and he be hanged by the neck till he is dead. Accused Nanju is sentenced to death for offence u/s 302/120-B RPC and he be hanged by the neck till he is dead. The sentence of conviction imposed upon the accused persons is submitted to the High Court in terms of Section 374 RPC for confirmation. Court further holds that It be noted that proceedings u/s 512 CrPc were initiated against accused Sanjay Kumar and general warrant of arrest had been issued against the said accused. As and when the general warrant of arrest against accused Sanjay Kumar is executed, the file may be requested from the High Court. |
