Jammu, Mar 26: The BJP has made it. It has become the largest party in the Rajya Sabha after the declarations of results. The tally of seats in Rajya Sabha after Friday's results suggested that the NDA could inch towards the half way mark of 123 if it gets the support of regional parties such as All India Anna Dravida Munnetra Kazhagam (AIADMK), TRS, YSR Congress and Biju Janata Dal (BJD).
The BJP's growing numbers in Rajya Sabha, along with those of its allies, will help Narendra Modi government reduce the numerical disadvantage it suffered in the Upper House. The BJP, with the help of some regional parties, can put it in touching distance of the majority mark. The shrinking gap, which will reduce further with the terms of three nominated MPs getting over soon, offers the government the opportunity to negotiate issued-based support from some non-NDA and non-UPA parties.
Its support among independents and nominated MPs will add to its ability to get key bills passed. The party has a majority on its own in Lok Sabha and with NDA partners, the number reached 315 in a House with a current strength of 540.
Now that the BJP has become a dominant force, along with its allies and some independent MPs, one can only hope that the BJP-led NDA Government would redress the grievances of the suffering people of Jammu province, including Hindu-Sikh refugees from Pakistan living in Jammu since 1947, daughters of Jammu & Kashmir whose children and spouses do not exercise any citizenship right anywhere in the state under what could be legitimately termed as unconstitutional Article 35A.
Article 35A was applied to Jammu & Kashmir without taking the Parliament into confidence or by invoking Article 368 of the Indian Constitution on May 14, 1954. It was this Article, which is not part of the main body of the Constitution but found place in an appendix. Article 35A not only creates invidious, unjust and humiliating distinctions between the "Permanent Residents" of Jammu & Kashmir and all other Indians across the country, but also makes similar distinctions between the "Permanent Residents" of Jammu & Kashmir and Hindu-Sikh refugees from Pakistan, notwithstanding the fact that they are hereditary Indians. Besides, this Article also deprives the children of the daughters of Jammu & Kashmir married to non-state subjects outside Jammu & Kashmir can't exercise any citizenship right in the state.
One can only hope that good sense would finally prevail and BJP Government at the Centre redressed the 70-year-old wrong committed by the Congress to appease separatists and communalists in Kashmir.
