| DB grants permission to hold exam of PLO | | | Early Times Report
Srinagar, May 25: A day after stay from writ Court regarding examination of Public Law Officers, a Division Bench of State High Court Comprising Acting Chief Justice Alok Aradhe and Justice MK Hanjura today modified the order of Single Judge dated May 24, 2018, and directed that the appellant shall be at liberty to hold the written examination. However, the result of the aforesaid written examination shall not be declared without leave of the Single Judge of this Court.
This significant direction has been passed in a LPA filed by the J&K Public Service Commission against the order of the Single Judge whereby Single Judge stayed operation of the impugned notice dated 10th of April, 2018.
Division Bench observed that facts giving rise to the filing of this appeal briefly stated are that in pursuance of notification dated 29.12.2016, the respondents applied for the posts of District Litigating Officers, Assistant Draftsman (Translation) and Assistant Legal Remembrancers / Public Law Officers. Thereafter, by a notice dated 10.04.2018, the date of examination was notified in respect of the aforesaid posts and the same was scheduled to be held on 27.05.2018. Being aggrieved the respondents approached this Court by filing a writ petition, namely, SWP No.1131/2018, inter alia, on the ground that Rule 51 of the PSC (Conduct and Procedure) Rules is not applicable to the fact situation of the case. Thereupon, the Single Judge on 24.05.2018 stayed the impugned notice dated 10th of April, 2018.
Division Bench Comprising Acting Chief Justice Alok Aradhe and Justice MK Hanjura after hearing both sides modified the interim order dated 24.05.2018 passed by the Single Judge and directed that the appellant shall be at liberty to hold the written examination. However, the result of the aforesaid written examination shall not be declared without leave of the Single Judge of this Court. |
