SHRC yet to make proactive disclosure of Info | Inspite of SICs direction | | Early Times Report Srinagar, June 9: Inspite of lapse of around 2 months the State Human Rights Commission (SHRC) is yet to adhere to the orders of the State Information Commission (SIC) for making proactive disclosure of information under section 4 of J&K RTI Act 2009. Sources. Details available with Early Times reveal that official website of J&K State Human Rights Commission (SHRC) www.jkshrc.com is yet to have a separate RTI column where details of Public Information Officers (PIO) First Appellate Authorities (FAA) could be accessed. In addition to it there are no details of voluntary disclosure / pro active disclosure under section 4 of J&K RTI Act 2009. After 24.4.2018 no other judgment has been uploaded on the SHRCs website Pertinently SHRC has been issuing notices to Government for violation of Human Rights by state police and other Government agencies but when it comes to adherence of RTI law SHRC has been caught on the wrong foot. In April this year State Information Commission had issued notice against SHRC for its failure to make voluntary disclosure of information under section 4 of J&K RTI Act 2009. Chief Information Commissioner Khurshid Ahmad Ganai had directed SHRC to adhere to this provision of RTI law, but SHRC has failed to abide by CICs orders … An appeal against SHRC came up for hearing before State Information Commission (SIC) on 12-04-2018 at Srinagar. The appellant Dr. Sheikh Ghulam Rasool stated that he had to file the second appeal before the SIC as he did not receive complete information in response to his RTI application filed before SHRC on 22-09-2017. In response to his first appeal, the First Appellate Authority (FAA) J&K SHRC directed the PIO to provide the balance information but still the information was not provided and appellant filed 2nd appeal before SIC. The appellant sought directions to be given to J&K SHRC for implementation of all the provisions of Section 4 of the J&K RTI Act and training for the officials in the Govt. i.e. PIOs and FAAs as there was wide spread ignorance about the RTI Act and the Rules among the PIOs and FAAs including that of SHRC. He demanded that information as prescribed under section 4 should at least be made available on the notice boards if it is difficult to host it on the websites due to lack of funds and competencies etc. CIC in his order dated 12.4.2018 said that FAA/PIO shall also ensure implementation of Section 4 as expeditiously as possible and also brief the Hon'ble Chairman J&K SHRC about the action taken and to be taken. "The first priority under section 4 disclosures should be the guidance that is required to be provided to those who approach the J&K State Human Rights Commission for redressal of their grievances and also for the RTI applicants and members of general public who want to know how the J&K SHRC functions to carry out the objectives enshrined under the J&K SHR Protection Act.
