PIL regarding failure of State to protect Mansar-Surinsar Lakes

Jammu, July 31: In a Public Interest Litigation filed by Sawan Nayyar who highlighted issue regarding failure of State to protect the Mansar-Surinsar Lakes, a Division Bench of state High Court Comprising Justice Dhiraj Singh Thakur and Justice Sanjay Kumar Gupta after hearing Adv Sumit Nayyar for the PIL issued notices to Union Ministry of Tourism and State through Principle Secretary to Government Tourism Department, Secretary of Tourism, State through Ministry of Tourism, Directorate of Tourism Jammu and Chief Executive Officer Surinsar-Mansar Development Authority returnable within three weeks.
Division Bench observed that two issues have been highlighted in the present petition. The first pertains to the failure on the part of the State to protect the Lakes of Mansar-Surinsar, which has some relevance from the religious point of view also. The second issue raised is with regard to discrimination being meted out to the areas of Surinsar and Mansar from a tourist point of view by the Government.
Division Bench headed by Dhiraj Singh Thakur observed that this Court cannot enter in that aspect of the matter which is squarely within the domain of the executive. How a particular area has to be developed and how much funding is to be allocated for attaining the desired result, is not a matter for this Court to decide. However, in the present case, keeping in view the averments made in the petition, we feel that some intervention may be required to ensure that the lakes are protected from the pollution.
During the course of hearing Adv Sumit Nayyar Submit that Jammu and Kashmir attracts from all over the world for its presence of religious temples and striking scenic beauty. Situated at a distance of 42 km from Jammu city, Surinsar Lake is known for its natural bounty and some mythological importance. Surrounded by thickly wooded mountain ranges and it is a popular picnic spot. The beauty and natural splendor of Surinsar Lake can be compared with the magnificence of Dal Lake and Nagin Lake of Srinagar.
