Court awards 8 years RI to husband, wife, two sons

Jammu, July 31: Principal Sessions Judge Jammu Vinod Chatterji Koul today awarded eight years rigorous imprisonment and fine Rs 5000/- to Tarsem Lal, his wife Darshana Kumari and his two sons namely Narinder Kumar alias Sonu and Mahinder Lal.
According to the police case on 20th of March 2011 complainant Janak Raj lodged a report with Police Station Miran Sahib stating therein that Tarsem Lal is his real uncle who is having old enmity with his father regarding the land. On the same day at about 10 AM he and his father Pyare Lal and one Kala Ram were going towards their fields and when they reached near the house of Tarsem Lal on main road, Tarsem Lal, Darshana Kumari, Narinder Kumar and Mohinder Lal after arming themselves with axes, lathies and Drath laid them in the way and assaulted them, as a result of which his father was grievously injured and he was taken to Government Medical College Jammu. On this report FIR No. 19/2011 for commission of offences punishable under sections 307/323/341/34 RPC was registered and investigation commenced. The deceased Pyare Lal succumbed to the injuries in Government Medical college, Jammu and offence under section 302 RPC was added in the FIR.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Badyal for the state whereas Adv Sanjay Mehta for the accused persons, sentenced the accused to undergo rigorous imprisonment for a term of eight years and also to pay fine of Rs. 10,000/- each for commission of offence punishable u/s 304 Part II RPC and in case of default in paying the fine, accused shall undergo further imprisonment of two months each. They are further sentenced to undergo imprisonment for a period of five years and also to pay fine of Rs. 5000/- each for offence punishable u/s 326 RPC along with 34 RPC and in case of default they shall further undergo imprisonment for a period of one month each. All the sentences, however, shall run concurrently.
