Jammu, Oct 1: In a significant order Justice Sanjay Kumar Gupta of J&K High Court (Jammu Wing) has directed the personal appearance of CBI's Investigating Officer along with case diaries of case FIR registered by CBI Special Crime Branch, Chandigarh vide No. RC-1(S) 2016/SCB/CHG dated 9th September, 2016 under section 363 RPC on the next date of hearing for explaining his conduct with regard to the steps taken regarding the tracing of 12 year old child Vishal son of Rajesh Sharma who mysteriously disappeared from Sabzi Mandi, Vijaypur on May 5, 2014 and could not be traced thereafter.
When this petition filed by father of the missing child namely Rajesh Sharma S/o Khazan Chand R/o Ward No. 5, Vijaypur (Samba) came up for hearing Advocates appearing for the petitioner submitted that it was on February 8, 2016 J&K High Court (Jammu Wing) transferred the Investigation of case FIR No. 6/2015 from Police Station Vijaypur to the Central Bureau of Investigation (CBI) as the Samba Police had miserably failed to trace the missing child and thereafter, the CBI Special Branch Chandigarh registered a regular case on September 9, 2016 under section 363 RPC and commenced the Investigation.
Advocates argued that more than two years have elapsed and the missing child is yet to be recovered by the CBI which has a specialized cell regarding child trafficking. He further submitted that I.O has lost interest in the case and is sitting idle as there is no headway in the Investigation so far.
After considering the submissions of Advocate, Justice Sanjay Kumar Gupta in the open court expressed dissatisfaction over the Status Report filed by the CBI and directed the personal appearance of the Investigating Officer (I.O) along the case diaries of the case on the next date of hearing i.e. October 17, 2018.
