HC directives in Safai Karacharis election

Jammu, Oct 13: In a petition filed by Akhil Bhartiya Safai Mazdoor Sangh seeking quashment of notification No. JMC/RO/CSKCE/2018/02-05 dated 03.10.2018 issued by respondent no. 4 whereby schedule for holding the election of Civil Safai karamchari union of JMC has been published.
Justice Dhiraj Singh Thakur after hearing Adv Sumit Nayyar for the petitioner whereas Sr. AAG SS Nanda for the State, directed that the election proposed to be held pursuant to notification dated 03rd October 2018 shall not be held unless a decision is taken on the representations filed by the petitioners as has been ordered by this court vide order dated 27th September, 2018.
While giving direction, Justice Dhiraj Singh Thakur observed that petitioner is aggrieved of the notification dated 03rd October 2018 by the respondent No. 4 which envisages holding of Civl Safai karamchari Union Election. The apprehension of the petition is that the employees of the municipality who are not Safaikaramcharis are also participating in the election process which will defeat the very purpose for which the election are held and that the same should be restricted strictly to that group of employees, who are actually the safai karamcharis. In the previous round of litigation, this issue was highlighted and by virtue of order dated 27th September 2018 the respondent has been directed to consider the representations filed by the petitioner and decide the same in accordance with law, learned counsel for the petitioners states that without deciding the said issue the respondents are proceedings a head to conduct the election.
