DB asks Law & Finance Department to remove pay disparity of staff of High Court

JAMMU, Oct 22: A Division Bench of High Court comprising Justice Dhiraj Singh Thakur and Justice Sindu Sharma today directed Law and Finance Department to take decision with regard to the pay parity of the staff of the High Court of J&K, based upon the data already provided by the High Court on the basis of 6th Pay Commission.
The DB observed that since the matter has been pending for a considerable period of time, it is hoped that next time no further adjournment would be sought on one pretext or the other and final decision taken by the Government shall be placed before this Court.
The bench observed that another issue highlighted by Joginder Singh who is petitioner, is that the prayer with regard to benefit under SRO 386 has not been given retrospectively in case of the Bench Secretaries of the High Court of J&K.
It is stated that the benefit although given to the secretaries ought to have been given to the bench secretaries also with effect from the date of recommendation by the High Court, based upon the judgment passed in this regard in their favour.
Upon this the DB directed that a decision be also taken by the government on the aforementioned issue. DB also directed senior AAG H A Siddiqui to file a detailed status report in this regard on the next date of hearing.
The petitioner submitted that once the rights of the staff are determined on the basis of the data prescribed on the basis of 6th Pay Commission it would certainly ensure for determining the rights of the petitioners under the 7th Pay Commission as well.
