Accession Day celebrations to be held on Oct 27

Jammu, Oct 25: "Maharaja Hari Singh, the Ruler of J&K signed the Instrument of Accession on 26th October, 1947 at Amar Singh Palace, Jammu in the presence of Union Home Secretary V.P. Menon.
It was presented to the Governor General, Lord Mountbatten in the early - morning hours on 27th October, 1947 for his acceptance. Lord Mountbatten accepted the offer but added post script, "The Will of the people of J&K shall be ascertained".
Prof. Bhim Singh says that this post script was totally irrational, improper and contrary to the Act of the British Parliament (1946) itself. However, the people of J&K had voted to elect their Legislative Assemblies times which have continuously approved Accession. The Accession was legitimate in the law yet Parliament of India has not cared to integrate Jammu and Kashmir till date. Article 370 is temporary has no relevance in the eyes of law. It is totally contrary to the Instrument of Accession signed by the Maharaja 71 years back."
Indian Parliament to honour the Instrument of Accession signed by Maharaja Hari Singh on 26th October, 1947and accepted by the then Governor General of India on 27th October, 1947. It should allow the Fundamental Rights enshrined in the Indian Constitution to flow into the State of J&K which has not been followed till date. Article 370 is temporary and could not have continued for 71 years stalling the Fundamental Rights of the Indian citizens residing in J&K. Besides imposition of Article 35(A) by the then President in 1954 was totally unconstitutional, undesirable as it curbed the Fundamental Rights guaranteed to the residents of J&K guaranteed in Chapter-III of the Indian Constitution. This is a matter of shame that the Indian Parliament has curbed its own power to legislate in respect of Defence, Foreign Affairs and Communications etc. even three subjects which were mentioned in the Instrument of Accession by Maharaja Hari Singh himself on 26th October, 1947 and accepted by the Governor General is he and 14 respect of 575 other states.
