Without seeking approval from CEO J&K, Housing Deptt issues transfer, promotion orders

SRINAGAR, Oct 25: Enforcement of model code of conduct (MCC) in view of Panchayat elections in the state has not made any difference for the Housing & Urban Development Department (H&UDD) since the department has issued many transfer and promotion orders over the past few days.
Early Times is in possession of some of these orders issued by the department over the past four days. The orders relate to the transfer of some officers and also regarding the placement of an officer at a higher position. The issuance of orders is a blatant violation of the MCC that is in force in the state these days.
"In the interest of administration it is hereby ordered that Abdul Rashid Vaid, Executive Officer, Municipal Committee Handwara and and Habibulla Derzi, Executive Officer, Municipal Committee Aishmuqam shall swap their place of posting with immediate effect," reads the order number 315-HUD of 2018 dated 24-10-2018.
It would be in place to mention here that office of Chief Electoral Officer (CEO), Jammu & Kashmir has made it clear that transfers in any department have to be made in case of dire emergency and for that it is necessary that permission is sought from the office of CEO, J&K.
"It is important that the concerned department makes a mention about the approval of transfers or any other administrative matter from the office of CEO, J&K. However, the H&UDD did not follow the norms and issue the order without any approval of the office of CEO, J&K," said sources.
The H&UDD also issued couple of orders on October 22, 2018 and here too no approval was received from the office of CEO, J&K. These orders relate to the transfer of an official and the placement (promotion) of an official to the higher position of Chief Executive Officer.
"In the interest of administration, Shri Mohammad Amin Paddar I/C Secretary Municipal Committee, Dooru is transferred and posted as in-charge Secretary Municipal Committee, Seer Hamdan against an available vacancy," reads the government order number 308-HUD of 2018 dated 22-10-2018.
The government order 306-HUD of 2018 dated 22-10-2018 reads, "Pending clearance by DPC sanction is hereby accorded to placement of Wali Mohammad Wani, Executive Officer, Municipal Committee Bandipora as incharge Chief Executive Officer subject to the following conditions."
The conditions mentioned in the government order are:
a) He shall work in his own pay and grade purely on temporary basis against available vacancy till the post is filled up under rules by the DPC.
b) His temporary arrangement shall not confer any preferential right on him to claim promotion on substantive basis which shall be considered by the DPC as per rules.
c) The arrangement will be without prejudice to the seniority and superior claim of others, if any, and subject to the outcome of the writ petition(s), if any, pending before the competent Court of law.
"Consequent upon the above Shri Wali Mohammad Wani is hereby posted as incharge Chief Executive Officer, Municipal Council Baramulla against an available vacancy relieving Shri Ghulam Rasool Shah I/C Executive Officer, Municipal Committee Pattan of the additional charge," the order reads further.
