SIC compiles 4 years report

Jammu, Nov 1: Jammu & Kashmir State Information Commission (JKSIC) which was created under act of state legislature to ensure transparency and accountability of public authorities had miserably failed to compile its annual reports from last 4 years. The commission has finally compiled the reports but is yet to make the same public. RTI activists on the other hand demanding that SIC must seek advise from constitutional experts and release the report as the report has to be presented before state legislature under the provisions of J&K RTI Act 2009.
The last report which was compiled by SIC was in 2013 and since then not a single report had been prepared. This was being criticized by RTI activists across state. Under the section 22 of J&K RTI Act 2009 , the State Information Commission shall, as soon as practicable after the end of each year, has prepare a report on the implementation of the provisions of the act during that year and forward the copy to the Government. Early Times had filed few reports on this issue few months back.
Section 22 further reads "Sub section 2 of this section says that each department shall, in relation to the Public Authorities within their jurisdiction, collect and provide such information to the State Information Commission as is required to prepare the report and comply with the requirements concerning the furnishing of that information and

By not coming up with annual reports from 2013 on-wards the J&K State Information Commission (JKSIC) had failed to adhere to the provisions of J&K RTI Act 2009. But as per sources the reports have been finally prepared but the same are not being made public as the annual report is to be presented before state legislature which is in a state of "suspended animation" from last 5 months.
" Assembly has not been suspended by Governor but Government has been suspended . This is a peculiar constitutional issue and State Information Commission must take guidance from constitutional experts of state. Governor on the other has legislative powers as well , so the reports can be presented to him as well and then made public " said Syed Nasarullah legal expert and RTI Activist
The last annual report was uploaded by SIC for the year 2013-14 on its official websites from that year on-wards not a single report had been prepared by the Commission. SIC had come up with its 1st report in 2011-12 , it comprised of 3 year report (2009-2010, 2010-2011,2011-2012) . In 2012 -13 G R Sufi the former Chief Information Commissioner (CIC) came up with a detailed and extensive report. He again came up with a report in 2013-14 , but after that no report has been published by SIC. It is only after several years SIC has now come up with several reports collectively.
