Accused gets 1 year jail term, fine for killing by rash, negligent driving

JAMMU, Jan 3: Judicial Magistrate, Ist class/2nd Additional Munsif Jammu awarded one year imprisonment and fine of Rs 2000 to one Sudershan Kumar Sharma of Ashok Nagar, Satwari Jammu facing trial in a case of death of one person by rash and negligent driving under section 279/304-A/RPC registered at Police Staion, Gandhi Nagar, Jammu.
As per press statement issued here, it states as brief facts of the case are that on March 25, 2012 Police Post Nehru Market received information through reliable sources that a Wagon-R car bearing registration number JKO2AH 2622 been driven by one Sudershan Kumar carelessly, negligently and rashly while proceeding from Panama Chowk towards Bikram Chowk. When the car reached near University of Jammu gate, it hit a motorcycle bearing registration number JKO2AS 9855 been driven by one Anil Gupta and caused accident. As the consequence of accident motorcyclist got injured who was taken to GMC Jammu for treatment.
On this information FIR No. 83/2012 for offence u/s 279 337 RPC stand registered and investigation started. Thereafter injured was taken to DMC Ludhiana for treatment where he succumbed to injury as such after completion of investigation offence u/S 279,304A stand established against accused namely Sudershan Kumar. Thereafter IO presented challan against accused.
After completion of investigation challan was presented in the court of law Judicial Magistrate 1st/2nd Additional Munsif Jammu after hearing PO Naveed Anjum appearing for the state and Counsel for the accused observed that the prosecution has proved his case beyond reasonable doubt and evidence of eye witnesses is also corroborated by medical evidence. The accused is proved to be guilty and liable to be convicted.
The court awarded simple imprisonment of one year and fine of Rs 2000 for commission of offence U/S 304-A/RPC, simple imprisonment of two months and fine of Rs 1000 for commission of offence U/S 279/RPC.
