1/3/2019 10:13:09 PM
Early Times Report
Srinagar, Jan 3: The Public Information Officer (PIO) of Govt Medical College Srinagar (GMC) might face penalty under section 17 of J&K RTI Act 2009 as the officers response filed before State Information Commission (SIC) is said to be unsatisfactory. The Commission had issued penalty notice against the PIO for remaining absent during several hearings. The designated PIO who is also the Personal Officer of GMC Srinagar had been asked to respond to the show cause notice within two weeks from issuance of the notice, but the response filed by her is said to be found not satisfying and she might have to face the wrath of SIC
As reported already an RTI application dated 20.03.2018 was filed by one Junaid Nazir a resident of Shaheed Gunj Srinagar seeking information from the PIO Government Medical College (GMC), Srinagar regarding details of employees working in Transport Section of (GMC) and the details about total number of vehicles in (GMC).
On failure of PIO to provide information within the specified period, the appellant filed First Appeal on 25.04.2018 submitting that no information has been provided by the PIO and praying for furnishing of information to the appellant without further loss of time. The First Appeal was not disposed of by the GMC's First Appellate Authority (FAA) within the statutory period forcing the appellant to file 2nd appeal before the State Information Commission (SIC) on 01.08.2018.
The appeal came up for hearing before the State Information Commission (SIC) on 24.10.2018. Nobody appeared before Commission on the said date of hearing. The hearing was adjourned with a direction to PIO to provide information as sought by the appellant within a period of two weeks and also to file counter statement to the 2nd appeal with an advance copy to the appellant by or before the next date of hearing. The appeal again came up for hearing before SIC Srinagar on 26.11.2018. Both the appellant as well as the respondent PIO did not attend the hearing.
Sources have told Early Times that response filed by PIO is unsatisfactory and she might face penalty under section 17 and Rs 25000 would be deducted from her salary for violating the RTI Act.
"SIC while issuing the order has said that continued absence of the parties during the consecutive hearings held by the Commission, the appeal is disposed of with a direction to the PIO to provide complete information to the appellant within a period of two weeks from the date of receipt of this order .The registry is also directed to issue a show cause notice to the PIO directing him to explain as to why penalty proceedings shall not be initiated against him for his failure to furnish information to the appellant within the period specified under Section 7(1) of the J&K RTI Act. The PIO shall be directed to file his reply within a period of 15 days from the date of issue of the notice by the registry " reads the previous order of SIC.
