jammu, Mar 5: Forces of disintegration are out in Kashmir to undermine Indian sovereignty in the sensitive border State of Jammu, Kashmir and Ladakh. They have turned so hostile that they now want the abolition of the office of Chief Minister and revival of the office of Wazir-e-Azam, saying the Jammu & Kashmir Assembly is quite competent to amend the Jammu & Kashmir Constitution of 1957.
"The Jammu & Kashmir legislature is 'absolutely competent' to restore the Prime Minister's post in the State by constitutional amendment," they on Monday said in Srinagar.
"Restoration of Wazir-e-Azam post demolished by Jammu & Kashmir legislature by virtue of 6th amendment 1965 under section 147 of Jammu & Kashmir Constitution. Section 147 empowers the State Legislature to amend the constitution," they further said, adding that "the amendment (1965) was made by Jammu & Kashmir Legislature in the constitution under Sec 147 saying that by the said amendment Sadr-i-Riyasat post and Prime Minister had been replaced by the Governor and Chief Minister".
"The state legislature which changed PM post is absolutely competent to restore the Prime Minister post under the same section 147 which had destroyed it by an amendment.
Since the restoration of PM post is within the jurisdiction of J&K legislature. The political parties are requested to make a public commitment that no sooner the first session of the assembly is convened the said restoration will be made for the same," they said, and added that "legally Indian Parliament has no role and the same is within the competence of JK Legislature".
It needs to be noted that it was in 1965 that the offices of Sadar-e-Riyasat and Wazir-e-Azam were abolished in the state and the offices of Governor and Chief Minister introduced to bring the state at par with other states of the Union. It was a great step forward towards the process of integration of Jammu & Kashmir into India and it had been widely welcomed.
The demand for the restoration of office of Wazir-e-Azam is as dangerous as it is divisive. The restoration of the office of Wazir-e-Azam will simply mean that Jammu & Kashmir is an independent country for all practical purposes. It will also create an impression the world over that Jammu & Kashmir is a disputed territory. Such a restoration will only help Pakistan achieve its 71-year-old break-India goal: Separation of Jammu & Kashmir from India on the basis of religion. The need of the time is integration of the state into India, and not disintegration.
