SIC drops penalty proceedings against AEE, warns him to be cautious in future

Srinagar, Apr 11: State Information Commission (SIC) has dropped penalty proceedings against an Assistant Executive Engineer (AEE) after the officer filed a detailed written statement by explaining the cause of delay which according to AEE was not intentional.
State Information Commission vide Order No.SIC/K/SA/77/2018/113 dated 11.10.2018, had directed for issuance of show cause notice to PIO/AEE Electric Sub-Division Bandipora as to why penalty proceedings should not be initiated against him for not providing information to an RTI applicant within the period specified under Section7(1) of the J&K RTI Act.
Details available with Early Times reveal that PIO was directed by SIC to file a written statement explaining the cause of delay within a period of 15 days from the date of receipt of the notice.
The hearing in the proceedings under Section-17 against AEE / PIO Riyaz Ahmad in the case titled Umar Shahi V/S Public Information Officer (PIO)/Assistant Executive Engineer, Electric Sub-Division, Bandipora was held on 27.03.2017 at SIC Srinagar
Riyaz Ahmad, (PIO)/Assistant Executive Engineer, Electric Sub-Division, Bandipora attended the proceedings before SIC. During the proceedings, Assistant Executive Engineer, Electric Sub-Division, Bandipora (also the designated PIO) submitted a written statement dated 25.03.2017 submitting there under that the delay caused in providing the information to the RTI applicant was not deliberate and there was no malafide intention in delaying the information to the applicant. The mass clerical strike and holding of additional charge of Electric Sub-Division, Gurez by the him resulted in delay in providing the information to the RTI applicant. The PIO further submitted that requisite information was provided to the RTI applicant through Executive Engineer, Electric Sub Division, Bandipora vide communication dated 08.11.2018 who as per verbal affirmation has expressed satisfaction with the information so provided to him.
SIC in its order said:
"The PIO accordingly prayed that the penalty proceedings initiated against him be dropped in view of aforementioned submissions. After hearing the PIO/Assistant Executive Engineer, Electric Sub Division, Bandipora and after pursuing the reply furnished by the said PIO, the 3 Commission is convinced with reply furnished by him regarding provision of information to the then RTI. Accordingly, the penalty proceedings initiated against Riyaz Ahmad, (PIO)/Assistant Executive Engineer, Electric Sub Division, Bandipora are hereby dropped. However, the officer is warned to remain cautious in future while dealing with RTI requests."
