DB directs Principal Secy Works to file response regarding release of funds
PIL regarding Road Widening from Dalgate-Hazratbal Road

Jammu, Apr 24: In a Public Interest Litigation Public related to the ongoing road widening programme in the city of Srinagar from Dalgate to Hazratbal, which commenced way back in the year 2009-10. A Division Bench of the State High Court Comprising Justice Ali Mohammad Magrey and Justice Tashi Rabstan directed Principal Secretary to Government Public Works Department, Kashmir to file response with reference to release of funds for completion of the project.
When the PIL came-up for hearing, Division Bench observed that Chief Engineer, PWD (R&B), Kashmir has filed affidavit, indicating the steps taken for ensuring disposal of the cases, pending before the various Courts with reference to subject of the completion of ongoing road widening from Dalgate to Hazratbal.
DB enquired AAG about the latest position of the cases, AAG submits that these cases are still pending decision before the Principal District, Srinagar, Sub Judge/Small Causes Court, Srinagar and this Court. Upon this DB directed AAG shall furnish the list of the writ petitions to the Registrar Judicial of this Court during the course of week and on receipt Registrar Judicial shall list all those cases before the roster Bench on 21.05.2019. Mr. M. A. Chashoo, AAG shall also ensure completion of the pleadings viz, filing of reply, before the Registry.
DB further directed Principal District Judge, Srinagar, shall ensure expeditious decision of the matters having reference to widening of the road from Dalgate to Hazratbal pending before its Court and other Courts of the district, details whereof shall be furnished to him by the Chief Engineer, PWD (R&B) Kashmir during the course of week.
DB further observed that in the status report, it is submitted that non-availability of the sufficient funds, the project is yet to be completed and the matter has taken up with the Administrative Department for release of funds. Upon this DB directed Principal Secretary to Government Public Works Department, Kashmir to file response with reference to release of funds for completion of the project. (JNF)
