MLC's demanded Justice for Sadhaya Arora

JAMMU, Apr 30: A joint press conference was addressed by MLCs Ashok Khajuria, Adv. Ramesh Arora, Ajay Bharti, Adv. Vibodh Gupta, Surinder Ambardar and Pardeep Sharma.
The legislators said that existence of human life on this earth is recognized as a "Right to Live" by human race and civilization and different laws are incorporated and adopted by different countries to protect Right to live. And if this right is snatched by someone, swear punishments are prescribed including death penalty by different countries even organized & unorganized groups recognize it as major offence against humanity. We cannot give liberty to anyone to kill a person in any circumstances those may be intentional, unintentional or due to negligence.
"We all are concerned about the existing system of medical treatment and non-professional approach of doctors in dealing with the patients. Many a times we have found people on road demanding inquiry for negligence of doctor's responsible for death during treatment. We cannot remain as silent spectator," said the legislators.
The legislators said that on October 23, 2016 Sadhaya Arora, 28 years old was compelled to leave this world and his existence was converted to non-existence by his death due to negligence of Doctor's in Government Medical College Jammu. A team of doctor's headed by Dr. Anil Mahajan treated Sadhaya in a manner which reflects total non-professional attitude, careless and casual approach towards a patient which was admitted for the treatment in GMC on 17th of Oct 2016 and the patient was reported suffering from Dengue Fever.
On the complaint of father of Sadhaya, Chief Minister vide order No. 979 G of 2016 Dt. 29-10-2016 ordered inquiry and a team of doctor's was constituted for the said purpose on 08-11-2016 vide order No. ES-3/MISC/2823-37. The committee constituted to look into the negligence includes Dr. Gurjeet Singh Soodan, Dr. K.K. Gupta, Dr. Deepak Kapoor, Dr. Rajat Gupta, Dr. Utra Sambyal.
The above said committee of doctors found many missing points in treatment given to Sadhaya also found negligence and non-professional approach of concern team of doctors who was giving treatment to the patient, they said.
"On November 25, 2016 father of the deceased submitted a complaint to Chairman of Legislative Council and also complaint was made to Chief Minister and Governor. Matter was discussed in house on 2nd January 2017 for negligence of doctor's in administering treatment of Sadhaya Arora resulting into his death on 23rd of October, 2016; on 4th of January, 2017 vide notification No. 18-LC of 2017 Dt. 04-01-2017, a joint House Committee was constituted by Chairman of LC," said legislators.
A committee was headed by Gulam Nabi Monga with members including MLAs G.M Saroori, Devinder Singh Rana, MLCs Dr. S. Bashir Ahmad Shah Veeri, Dr. Shehnaz Ganai, Vibodh Gupta, Firdous Tak, Surinder Kumar Chowdhary, Ali Mohammad Dar.
That committee submitted its report in upper house after examine the whole issue also considered the reports submitted by local doctors and also taking assistance of 2 doctor's outside the state and after examing the consult doctors came to the conclusion "that death has been caused due to the negligence of the concerned HOD and team of doctor's"
Recommendations of committee at page 13 Para 1- "on the basis of the above statements the committee recommends stern disciplinary action against the concerned HOD and team of doctors who were involved in the medical treatment of the deceased, late Sadhya Arora".
That final report was also submitted by Chairman stating there in that action is recommended against Dr. Anil Mahajan and his team because they are responsible for negligence in treatment resulting into death of Sadhya.
The report of Joint House Committee was considered by Upper House and was sent to Govt./Chief Secretary for further action. Chief Secretary after considering the report and taking legal opinion sent the same of Government Administrative Department (GAD) for action. GAD after considering the report asked Commissioner Secretary Health Department to take action as per report. Now the problem started and matter was delayed on one or other pretext.
Now we all are concerned that negligence with the death due to negligence has become a routine matter in GMC hospital even few days back a pregnant lady was not given treatment in time admitted in SMGS and shifted to GMC. A protest was made by relatives in public and action against concerned doctors was demanded.
That we cannot allow an institution to work in a manner it is working although Govt has provided maximum facilities but we feel many doctors are lacking commitment to the profession and do not discharge their duties with minimum standards required to be maintained during treatment .
Although Assembly has been dissolved otherwise matter could have been taken up there but we feel our responsibility to make issue public and asked the concerned to take action against those who are responsible for the death of Sadhaya who was gem and asset for nation in the field of computer technology.
