Forest Deptt Poonch acts tough against illegally mutated forest area
5 cases of measuring 221 kanals land got cancelled, 36 kanals land evicted

Jammu, Dec 3: Taking strict against illegally encroached Forest land, the Forest Department Poonch got cancelled illegally mutated area measuring 221 kanal on forest land in five cases and got recorded in favour of Forest Department in revenue record.
As per order available with the Early Times, Divisional Forest Officer Poonch vide letter No. DFO/PFD/3703-08 dated:-25-02-2019 has informed that Khasra No. 327 measuring 273 Kanal at Village Nar Tehsil Mendhar is forest land and recorded as Chair Mumkin Jungle in Misl-e-Haqiyat of 1961-62.
It further said that the Forest Department Poonch regarding provision of standing order 23-A Mutation, illegal mutation on exempted land have been treated void. In the 5 cases, illegally mutated area measuring 221 Kanal on forest land have been cancelled and recorded in favor of forest department in revenue record.
"Since 2012-13, Division office was pursuing most of these cases in revenue courts and currently these appeals have been withdrawn from revenue courts and pursued for treating these illegal mutation as void under provision to avoid any delay due to appeal procedure as such Forest Department has no procedure to appeal under forest Act. 36 Kanals have already been evicted and fenced and rest area will be evicted from encroachers soon," said a senior Forest Official.
The order reads "Standing order No. 23-A Mutation, Para 104 lays down that mutation against statutory provisions are not recognised by law as held in a case that transfer which are not recognized by law are void and can not be enforced by mutations and that mutation cann't be carried out of a transaction which contravened an express provisions of the statutory law.
It further reads that in case of disputes of status of land between Revenue and Forest Department, matter has to be resolved jointly by team of Revenue and Forest Department on basis of records of rights, Aks/Tatima and demarcation files and matter of facts has to be operated/endorsed.
