CJM Jammu seeks personal appearance of CE M&RE, Jammu

Jammu, Dec 18: Taking serious note of non-compliance of the court order dated 15-10- 2019 whereby court of Chief Judicial Magistrate Jammu directed the Chief Engineer PDD (M&RE) to file compliance report with regard to the execution of decree dated 29-11- 2008, Chief Judicial Magistrate Jammu Deepak Sethi today sought personal appearance of the Chief Engineer PDD M&RE Jammu on next date of hearing i.e. 6-1-2020.
As per the details available with Early Times, a case titled Kulwant Singh Vs Chief Secretary and others wherein the court has passed an order on 29th November 2008 whereby judgememt debtors are directed to remove electrical poles and electrical transformer installed within the boundary wall of the decree holder.
When the matter came up for hearing, Decree holder counsel Mohammad Irfan drew the attention of the court towards the court order dated 15-10-2019 whereby court directed the Judgment debtor No.2 CE PDD M&RE Division Jammu to file compliance report but neither counsel for the Chief Engineer wass present nor his Counsel as last opportunity was being provided to them to file compliance report failing which counsel shall remain present.
Counsel of decree holder further submitted that CE is not implementing the court order which speaks of its contemptous attitude towards the court order and also pleaded that Decree holder is old and ailing and this execution petition have been filed on 14th of September 2018- but the Chief Engineer concern have no regards for the court order despite services notices upon him and he sought time on one pretext or other which wrecks havoc for the decree holder as the electrical transformer and poles installed within the residential house of decree holder whereby there is every apprehension of some untowards incident would happen.
After considering the submissions of the decree holder counsel Mohd Irfan, CJM Jammu directed that CE PDD M&RE (Judgement debtor) shall remain present in person in court on next date of hearing on 6-1-2020.
