| JK’s pending graft cases to be transferred to CBI | | Central agency tasked to expedite inquiries, submit reports without delay | | EARLY TIMES REPORT
Jammu, Dec 24: The Jammu and Kashmir government is all set to transfer the pending graft cases registered in the erstwhile state of Jammu and Kashmir to the Central Bureau of Investigation (CBI) with cases gathering dust in State Accountability Commission (SAC) being given top priority.
As per the official sources, post creation of Union Territory on October 31, this year, the government was mulling to get the Jammu and Kashmir’s anti-graft bodies under the purview of central anti corruption agencies and in the recent past, it was decided that Jammu and Kashmir’s anti- corruption bureau will now be headed by the CBI with its staff coming under its control.
In the meantime, there are reports being received about the graft cases of the past being re-investigated by the CBI itself with cases which earlier were gathering dust in the SAC to be given a prime focus. It is being divulged by the official sources that the government is adamant of not only expediting the inquiry into present corruption cases but will also priorities in probing the past graft cases registered in SAC in the past.
SAC which was constituted in 2003 witnessed the appointment of late justice R.P. Sethias its Chairman. With the tainted babus and ministers started feeling tremors, irony shrouded the entire initiative. As it was expected that something tangible is going to happen, scams, embezzlements started coming out from the Government kitty, rendering the Commission as a toothless tiger.
More ironic and surprising is that not even a single minister with the alleged tainted past has been punished by the commission since its inception with the inaction of the past regimes letting the corrupt to fly on sky nine.
As people had pinned much hopes that the establishment of SAC would make the helmsmen more accountable before the common masses, making the commission powerless has once again vindicated the saying that ministers can never be punished, not now, not then.
Meanwhile, according to the officials, the SAC even
before its dissolution used to entertain no complaints against the bureaucrats and helmsmen as the government had equipped it with least resources to keep a check on the rising graft cases being reported in the erstwhile state of Jammu and Kashmir.
The SAC had remained defunct since 2015 because all its members had completed their term of office. The SAC at present, as per its chairman, is not functioning at all. Reports informed that scores of amendments made by successive regimes in the SAC Act resulted in exclusion of the public administration from the jurisdiction of SAC. The Act, that was ought to put bigwigs under the scrutiny, has been undermined by the Government. Its jurisdiction has been taken away by excluding public servants, Government companies, public sector undertakings and universities which in public perception are cases of suspected corruption. Now its jurisdiction has been limited to political class only against whom there are no complaints being received at all. Reports informed that in 2011, the political class and bureaucracy seemed to have joined hands that time to defeat the Act due to which it has been rendered impotent now.
