Direct respondents to consider petitioner’s claim for post of Director YSS

JAMMU, Apr 22: In a LPA filed by Madan Lal against the judgment of Writ Court whereby Writ Court dismissed the petition challenging Government Order No. 137-Edu (Tech) dated 07.07.2014 vide which the case of the petitioner for promotion as Director, Youth Services and Sports (YSS) Department, J & K, was rejected as pre-mature.
A Division Bench of J&K High Court comprising Justice Tashi Rabstan and Justice Sanjeev Kumar after hearing Adv Sudershan Sharma for the appellant today set-aside the judgment of writ Court and allow the LPA filed by petitioner, quashed the Government Order No.137-Edu(Tech) dated 07.07.2014.
Division Bench also directed respondents to consider the claim of the petitioner for his appointment against the post of Director, Youth Services and Sports w.e.f. 01.01.2014 strictly as per the Recruitment Rules of 2013 with all consequential benefits. Let an appropriate order in this regard be passed by the respondents within a period of eight weeks from the date certified copy of this judgment is made available to the respondents.
