Jammu, Aug 18: A Division Bench of the J&K High Court has put various government agencies and a private builder on notice for constructing flats on the land owned by Jammu Development Authority (JDA).
The Division Bench comprising Chief Justice Gita Mittal and Justice Vinod Chatterji Koul took cognizance of a writ petition filed by Rajinder Singh Jamwal wherein the petitioner had highlighted that the building permission for construction of flats was given by Jammu Municipal Corporation in favour of J&K Cooperative Housing Corporation Ltd., New Plots, Jammu with regard to private land measuring 9 Kanals 10 Marlas comprised in Khasra No. 4&5 situated at Sidhra, Jammu whereas the construction was fraudulently raised over JDA land falling under Khasra No. 3 min at Village Sidhra.
After hearing petitioner-in-person, the Division Bench took serious note of the matter and issued notices to the Enforcement Directorate(ED) Govt of India, Anti-Corruption Bureau(ACB) J&K, Comm./Secy. To Govt of J&K (Revenue Department), VC JDA, V.K. Magoo Ex-Chairman J&K Housing Cooperative Society Ltd. Jammu, Managing Director J&K Cooperative Housing Corporation Ltd. Jammu , Naresh Sabarwal S/o R K Sabarwal R/o Trikuta Nagar Jammu (Builder) and Horizon Construction C-36, Gulmohar Park, New Delhi requiring all of them to file their replies within 10 days of the receipt of the notice. Sr. AAG S S Nanda accepted notice on behalf of Revenue Department J&k Govt.
In the petition, the petitioner has levelled serious allegations against the office bearers of J&K Cooperative Housing Corporation Ltd. as well as the Builder- Horizon Construction in the construction of River Castle Apartments at Tawi Vihar Sidhra as the petitioner has contended that he alongwith other purchasers have been duped of their valuable money as the construction of flats was done on government land transferred to JDA and in the said conspiracy the then Chairman of the J&K Housing Cooperative Society V K Magoo played a key role and the JDA land was grabbed in an organized manner. In the petition it is further stated that when JDA came to know about the fraud, it stopped the construction and initiated eviction proceedings but the builder without any locus standi filed a writ petition OWP No. 1326/2014 through one Manjeet Singh who is an employee of Naresh Sabarwal and an interim direction was obtained for continuing the construction wherein Senior Advocate B S Slathia appeared (since expired). The petitioner had also arrayed B S Slathia, Sr. Advocate as respondent, however the Division Bench observed in the order that Advocate B S Slathia has expired. The DB has also directed the petitioner to file an amended Memo of Parties within three days. (JNF)
