Court dismisses plea of alleged criminal seeking registration of FIR against Cop

JAMMU, Mar 19: CJM Reasi Amarjit Singh Langeh while dismissing the plea of an alleged criminal who is under-trial seeking registration of FIR against DYSP, SHO & Ors, observed that a growing trend in recent times to invoke provisions of Code of Criminal Procedure regarding investigation and inquiry as a handy tool against public officials performing public duty, is not only unenviable but also un-acceptable.
During the course of jail visit at Sub Jail Reasi, applicant who is detained there for his alleged involvement in FIR No. 81/2020 for offence under section 376 of IPC and thus is a jail inmate - presented an application to Chairman, DLSA (Pr. Distt. & Sessions Judge), Reasi seeking action against police officers/ police officials of Police Station Mahore. This application in turn - is forwarded to undersigned by Worthy Chairman, DLSA Reasi for disposal under law. This is how matter lands up in this court.
The applicant alleged that on 13-10-2020, non-applicants dragged him out of his residential house and forcibly took possession thereof and implicated him in a false FIR, in which applicant- as per communication of Chairman, DLSA is allegedly involved in as serious an offence as one under 376 of IPC. Applicant also alleged that ornaments were taken away and his house was also ransacked by non-applicants. He also asserted that an application moved in this regard before the Judicial Magistrate 1st Class, Mahore was declined to be entertained.
CJM Reasi Amarjit Singh observed that in the status report that applicant herein is trying his level best to mislead the administration and has left no stone unturned to implicate those who have taken action against him. It is also asserted that applicant can go to any extent to malign images of officials with an objective to get benefit in the aforesaid case sub-judice against him for offence under section 376 of IPC.
The CJM Reasi observed that not only applicant is facing trial in a case bearing FIR No. 81/2020 for offence under section 376 of IPC and is presently lodged at Sub Jail Reasi but there are ten other FIRs registered against him in Police Station Mahore as disclosed in the status report submitted by SSP Reasi.
