NIA Court frames charges against 4 HM terrorists in Parihar brothers’ murder case

JAMMU, June 30: Special Judge NIA today framed charges against four HM terrorists in much publicized murder case of Anil Parihar (State Secretary of Jammu and Kashmir BJP) and his brother Ajeet Parihar in Kishtwar by terrorists belonging to banned terrorist organization Hizbul Mujahideen.
Special Judge NIA Sunit Gupta after hearing Special PP Baldev Singh for the NIA whereas Advocate IH Bhat and Deepika Singh Rajawat for the accused persons including Nisar Ahmed Sheikh, Nisar Ahmed Butt, Azad Hussain Bagwan and Rustam Ali Bagwan observed that prima facie the offences under sections 302/120-B/109/34 of RPC, sections 18/19/39 of UA(P) Act are made out against the accused Nisar Ahmed Sheikh, whereas, the offences under sections 13/19/39 of UA(P) Act are prima facie made out against the accused persons namely Nlshad Ahmed Butt. Azad Hussaln and Rustam Ali Bhagwan.
Brief facts of the present case are to the effect that on 1 Nov 2018 an information was received at P/S Kishtwar at about 20:45 hours that Anil Kumar Parihar and Ajeet Kumar Parihar, both sons of Laxman Dass of Main Bazar Kishtwar were returning to their house in the evening after closing their shop at about 20:40 hours, when both of them reached at Tappal Gall, some unknown criminals who were equipped with illegal weapons opened fired on them.
Dead bodies of both the said persons were lying on the spot and the assailants managed to escape from the spot after the commission of crime.
In this regard an FIR No 290/ 2018 dated 1 Nov 2018 was registered at P/S Kishtwar for the offences under sections 302 RPC and section 7/27 Arms Act.
It is worthwhile to mention here that during the Investigation of the present case, the accused persons Osama-bln-javed and Zahid Hussain were killed during an encounter with the security forces on 28th Sept 2019 within the jurisdiction of police station Batote District Ramban and in this regard an FIR No 84/2019 was registered with P/S Batote.
Similarly, the accused Haroon Abbas Wani was also killed during an encounter with the security forces on 15in Jan.2020 at Doda. In this regard, an FIR No.06/2020 was registered with P/S Doda. As such, the proceedings against the accused persons Osama-bin-Javed, Haroon Abbas Wani and Zahid Hussain have been abated vide order dated 18.11.2020 after recording satisfaction about their deaths.
