JAMMU, June 14: In the much publicized case of controversial bungalow of ex-Deputy CM, Dr. Nirmal Singh and his wife Mamta Singh situated at Ban/Panjgrain (Nagrota), the final hearing was adjourned by Member (Judicial) Rajesh Sekhri of J&K Special Tribunal, Jammu because of the absence of the counsel for the Jammu Development Authority (JDA) and in view of his non-availability, the J&K Special Tribunal adjourned the case for Final Arguments on August 2, 2022 and in the meantime the Tribunal further extended the stay on the demolition of the residential house.
On the last date of hearing, the J&K Special Tribunal had dismissed the application filed by whistleblower Advocate Muzzaffar Ali Shah on whose RTI Application, it came to light that the Singh and his wife have raised the construction of a palatial house at Ban (Nagrota), Jammu without getting Building Permission from the Jammu Development Authority.
The Tribunal had observed that it is for JDA to defend demolition notice on the basis of material on record. The JDA on November 8, 2021 had issued final demolition notice under Section 7 (3) of The Building Control Operations Act, 1988 directing Dr. Singh and his wife to demolish the alleged illegal/unauthorized construction.
However, Mamta filed an appeal against the demolition order and obtained interim relief from the J&K Special Tribunal, Jammu, whereby the demolition was stayed. The J&K Special Tribunal had fixed the matter for final hearing but counsel for the JDA absented himself and the much awaited important hearing had to be adjourned by the J&K Special Tribunal for August 2, 2022.
