Chopra Murder case: Ex-MLC Wazir facing trial denied 'parole' | | | Jammu, June 14: Principal Sessions Judge Jammu R S Jain today denied 'parole' to Tarlochan Singh Wazir Ex-MLC who is facing trial in much publicized Chopra Family Murder case. Principal Sessions Judge Jammu R S Jain today after hearing Sr Adv KS Johal with Advocate Rajesh Kumar for the Ex-MLC Tarlochan Singh Wazir whereas Additional Public Prosecutor Vijay Kumar Sharma observed that allegations against the accused in the present case are that he entered into a criminal conspiracy with other accused and in pursuance of the criminal conspiracy committed murder of five persons. Though petitioner seeks bail for a limited period so, as to entitle him to get proper medical treatment under proper conditions, but looking to the allegations leveled against the accused and the larger interest of the State and the public as well as the settled law, the court is of the opinion that no good ground is made out for granting parole to the petitioner Trilochan Singh Wazir. Court also maintained that it may be noted that vide Order dtd 27/3/2014, the Court had directed Superintendent, District Jail, Jammu to get the petitioner examined in AIIMS, New Delhi under proper escort and follow the treatment advised by the doctors and proceeded to dismiss the bail application and since then, there has been no change in the circumstances to grant parole to the petitioner. Hence application for grant of parole is dismissed. According to the case that on September 18, 2006 the police received information from reliable source that in Sector No.3. H. No. 38, Trikuta Nagar, Jammu on the preceding night some persons have killed Rajinder Bhushan Chopra, his wife Madhu Chopra, his daughter Saloni Chopra, servant Sonu and driver Jagan by having tied from their hands and legs. A case under FIR No. 107/2006 U/S 302 RPC stands registered and investigation was started thereupon. However after six years of investigation police recorded the statement of one Surinder Singh and on the statement of Surinder Singh Police arrested Tarlochan Singh Wazir Ex-MLC and Ors in conspiracy for killing the chopra and his family. Petitioner Tarlochan Singh Wazir, an under trial, currently facing trial in a case for offence under section 302 RPC has filed the present application for the relief of being released on parole so as to enable him to undergo medical treatment in a hospital outside the State since the required treatment is not available in the GMC hospital, Jammu. It has been further averred in the application that pursuant to the order dtd 27/3/2014, petitioner was taken to AIIMS, New Delhi on 31/3/2014 where he was given appointment for 4/4/2014 and thus the petitioner was brought back to District Jail Jammu. On 4/4/2014, the petitioner was again taken to AIIMS, New Delhi where 23/4/2014 has been fixed for conducting the EVLA test to be conducted by Cardio-Thoracic and neuro-Sciences Centre, New Delhi and the doctors have also diagnosed the petitioner to be a patient of neurology and urological problems. In the application, petitioner has taken the stand that the he has visited New Delhi under police escort by road 2/3 times but under constant stress and strain. That the petitioner had to go to AIIMS for operation on 16/5/2014 but could not go there because of the reason he had to travel all the times a distance of 600 kms that too with the police squad in the police van. The body of the petitioner because of the ailments being suffered by him does not allow him to travel so much. It has further aggravated the physical condition of the applicant. (JNF) |
