Constructions on Agri land: DB asks Div Com to intervene

srinagar, July 16: A Division Bench of Jammu and Kashmir High Court has asked Divisional Commissioner, Kashmir, to ask concerned police to ensure that no constructions are carried out on agriculture land in Pampore area of south Kashmir.
The Division Bench of Chief Justice M M Kumar and Justice HasnainMassodi was hearing an application, seeking directions for demolition of the illegal structure and direction to Deputy Commissioner, Pulwama, to file compliance of all the directions passed in PIL (Human Watch International) pertaining to constructions on agriculture land, particularly situated behind court complex Pampore and alongside Gousiya Colony, Pampore.
The applicant had also sought direction to SSP, Awantipora, to register FIR under section 188 of RPC and other provisions against the violators -- Tariq Ahmad (broker) and Nazir Ahmad Mir of Frestbal, Pampore.
When the matter came up for hearing on June 13, the court took serious note of the "wanton violations" of varieties of laws and issued directions that constructions behind court complex Pampore and alongside Gousiya colony shall remain stayed.
It also directed Deputy Commissioner Pulwama to file status report in respect of various directions passed with respect to the PIL. TehsildarPampore was also asked to furnish details and appear in person in the court.
The court had also clarified that if any of its directions were violated, SSP Awantipora would file appropriate FIR against the violators by invoking the penal laws.
When the matter came up for further consideration today, tehsildar Abdul Rehman Dar was present and conceded that illegal construction was in progress despite the fact that various reports have been submitted by him to the police for action against the violators.
He also pointed out that the violators indulge in certain activities and fill up the land by filling earth during the night time.
After his submissions, the court asked him to submit complete information by filing an affidavit.
"It appears that the directions issued by the court on June 13, 2014, are being violated with impunity, even the DC Pulwama has not taken any care to comply with the directions issued," the court said, and accordingly directed Divisional Commissioner Kashmir to attend to the wakeup call and direct the concerned police officers to ensure that no land filling activity or constructions are carried out.
"We also direct that Tariq Ahmad and Nasir Ahmad Mir be issued bailable warrant which is the only course left with the court to stop the illegal activities. The bailable warrants shall be executed by SP Awantipora. He may accept bail bond from both the persons for sum of Rs 50,000 with one surety of equal amount. The status of cases registered with regard to illegal constructions at Pampore shall be furnished," the bench directed.
