SVC detects abuse of Roshni Act, recommends action against guilty officers | **Prime state land in Srinagar mutated in dead woman's name; ex-JMC employee turns out to be main accused | | Early Times Report JAMMU, July 16: In what can be construed as the major abuse of the Roshni Act provisions in the state, the State Vigilance Commission (SVC) has discovered that four kanals of prime land at Rajbagh in Srinagar was mutated in the name of a dead woman and later transferred by an ex-employee of Jammu Municipal Corporation (JMC) in his name allegedly through a "fake" will deed. The SVC has asked the State Vigilance Organisation (SVO) to register a case in the matter for its thorough investigation and written to the Chief Secretary for administrative action against the delinquent revenue officers who had mutated the land. A grand hotel stands constructed on this land. In a handout issued here today, the SVO said on the basis of a probe conducted by it, it was revealed that one Sita Devi was conferred the ownership rights of prime state land measuring 4 kanals at Rajbagh under Roshni Act after clearance by Divisional Commissioner, Kashmir, on June 30, 2007. The recommendation in this regard was made by Nazool Department against a payment of Rs 72 lakh to be paid by Sita Devi. Interestingly, Deputy Commissioner, Srinagar, on March 4, 2008 ordered the conferment of ownership rights upon Sita Devi for 4 kanals of land under survey No 1317 and 1318 in estate Nursing-grah though she had already expired on January 21, 2008. The inquiry revealed that one Shamsher Singh Manhas, who represented himself as an attorney holder of Sitadevi, allegedly in connivance with the concerned revenue authorities got the mutation entered in the mutation register in favour of Sita Devi on April 16, 2008 though only part payment of Rs 54 lakh had been made and Sita Devi was already dead. Thus, with the alleged efforts of Manhas, ownership rights of the state land were conferred on Sita Devi, a dead person. In the Jamabandi register, Sita was entered as owner and the land was shown in her personal possession. Strange enough on the same date Naib Tehsildar, after entering the deceased Sita as the owner of the land by showing the land in her personal possession, mutated it in the name of Manhas on the basis of a "fake" will deed which was under SVC scrutiny, the handout added. As per the complaint, the land has further been handed over by Manhas to Mohammad Younus, son of Ghulam Ali Dar of Nowshera, Srinagar, and Hakim Zaffar Ali, son of Hakim Shair Ali of Nishat under Agreement to Sell for a consideration of Rs 15 cr. A commercial hotel has been constructed by Manhas on this land. Holding that these facts prima-facie disclose commission of a cognizable offence by the revenue officials in connivance with Manhas and others, the SVC directed Director, Vigilance Organisation, to register a case against the concerned officials for a thorough investigation. This apart, a reference had also been sent to the state Chief Secretary with the recommendation to take administrative action against delinquent revenue officers and restore the disputed land as per law. Manhas is an ex-employee of JMC. He was likely to be picked up by the investigating agency for questioning, sources said. |
