Twist in sexual exploitation case, complainant teacher being framed as accused

BARAMULLA, July 16: A Government school teacher, who claims to have first highlighted the case of sexual exploitation of girls in Baramulla district, is now being framed as an accused in the case allegedly at the behest of a powerful lobby which is stated to be running the racket.
The teacher claimed that he was being framed as an accused in the case to "silence" him.
Abdul Hamid Ganie, a teacher in a Government girls high school at Wanigam in Pattan Tehsil of Baramulla, claimed that he had sent a letter in 2008 to the district magistrate, alerting him about the alleged sexual exploitation of minor girls by some Government officials.
The district magistrate had then referred his complaiant to the district police chief for investigations, Ganie said.
He claimed that, two days later, a rape case was filed against him in the police station at the same behest of the girl student whom he wanted to protect from exploitation.
Ganie alleged that in order to implicate him in what he claims is a false case, police in Baramulla recorded two statements of the girl under section 164-A of the criminal procedure code.
According to the FIR, the girl alleged that Ganie had waylaid her near an orchard while she was returning home from school and made an unsuccessful bid to rape her.
In her second statement made under section 164- A, the girl told the magistrate that she had been raped by the teacher three times.
Legal experts say negating a previous statement before a magistrate is perjury which is a criminal offence.
A departmental inquiry ordered on the instructions of Director of School Education Kashmir (DSEK) did not find any substance in the girl's accusation because the incident was claimed to have taken place on a day the school was closed.
"The sequence of events led the quorum to believe that the (victim) is in a state of dilemma. Intends to involve the accused teacher in a false and fabricated case and use it as cover for her reported involvement in some sex scandal," the departmental inquiry concluded.
The teacher has alleged that a powerful nexus of people are running sexual exploitation rackets in Baramulla District and are targeting him so that nobody dares act as a whistle blower in the future.
"It seems that people involved in the racket are compelling the girl to stand on her own statements otherwise she will have to face dire consequences," the teacher alleged.
