Court awards 3 yrs RI to former Post Master after 12 year trial | | | Jammu, July 16 : Special Excise Mobile Magistrate Jammu Amarjeet Singh Langeh today awarded 3 years rigorous imprisonment to then Branch Post Master Akalpur Mohinder Pal S/o Brita Ram r/o Village Akalpur Tehsil and District Jammu who was facing trial in last 12 years for misappropriating the amount of innocents by issuing plain paper receipt and by not crediting the received amount in the Govt Accounts. According to the police case Assistant Supt Post Officer Sub-Division Gandhi Nagar Jammu lodged a complaint with P/S Domana on January 21, 2002 for registration of FIR against Mohinder Pal with the narrative that accused while working as Branch Post Master Akalpur misappropriated the amount of Rs 58000/- of innocent people by issuing plain paper receipt and by not crediting the received amount in the Govt Accounts. On this police registered a case u/s 420/409 RPC and after completion of investigation challan was presented in the court. Special Excise Mobile Magistrate Jammu Amarjeet Singh Langeh after hearing Senior Prosecuting Officer Jatinder Anand appearing for the state observed that prosecution has successfully established involvement of accused in commission of offences and further observed that it is trite that punishment required to be imposed upon an offences must be proportionate to the gravity of crime he has committed. The distinguishing feature of instant case is that accused held out position of confidentiality and fiduciary character as Branch Post Master of the concerned post office and by misappropriating the money entrusted to him by various depositors and that too dishonestly and fraudulently, accused has not only defrauded the depositors concerned but has also dwindled the confidence of depositors and his employer department in the position of faith and trust that he held at the relevant time. With these observations Court awarded 2 years rigorous imprisonment and fine Rs 3000 u/s 409 RPC and one year RI u/s 420 RPC. Court further clarified that both the sentences shall run concurrently.
