India should retain death penalty for criminals and terrorists

A globally renowned lawyer Robert Badinter who has also served as Minister of Justice in France has said that the death penalty is not a deterrent to crime and terrorism . According to Robert , " Crime is horrible and people must be protected against . But the fact is that crime has always been horrible and death penalty is not the solution . Terrorists have special relationship with death . A man who can blow himself in a supermarket and kill 50 people will not be dissuaded by the threat of death penalty " . Robert Badinter further asks Indian nation to abolish death penalty saying that "India is a specific unique nation in the world carrying on a message of non-violence. But the continuance of death penalty in the country contradicts the culture of non-violence symbolized by India," . There are many such people who call for abolition of death penalty by India . These people argue that with the death penalty, you are deliberately deciding punishment by death for a criminal. This is the same concept as eye for an eye and tooth for a tooth. It violates human rights by the government forcing the death of a human . It is a barbaric way to deal with murder. The risk of executing innocent people exists in any justice system. There have been and always will be cases of executions of innocent people. No matter how developed a justice system is, it will always remain susceptible to human failure. Unlike prison sentences, the death penalty is irreversible and irreparable. The death penalty does not deter crime effectively . Amnesty International also opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual. In this scenario I want to raise following hypothetical questions . If it is hypothetically possible to bring to justice to the killers of LALA JAGAT CHOPRA and his son LALA RAMESH CHOPRA owners of Punjab kesri newspaper , then should they be given death penality or not ? We all know that LALA JAGAT NARAIN CHOPRA was an Arya Samaji and he served as personal secretary to LALA LAJPAT RAI before independence . Both LALA JAGAT CHOPRA and his son LALA RAMESH CHOPRA were killed by criminal elements . What right those elements had to take life of law abiding citizens ? Should there be death penalty in such cases or not ? Again if it is hypothetically possible to bring to justice the perpetrators of Wandahama massacre of Kashmiri Pandits in 1998 , then should there be death penalty in such cases or not ? According to newspaper reports in January 1998 , militants killed 23 Pandits in Kashmir and those killers were later gunned down by the security forces . But the masterminds of such attacks are still not apprehended and perhaps they are hiding inside Pakistan . If in future those masterminds are caught then should they be given death penalty or not ? Again in year 2003 , there was another carnage in which 24 Kashmiri Pandits were killed in Nadimarg village near Shopian and the master minds of that attack may still be alive . Hypothetically if it becomes possible to catch those master minds in future then should those be given death penalty or not ? Further should the perpetrators of the sikh riots in 1984 be given death penalty or not ? Should the perpetrators of any riots in India be given death penalty or not ? Is our nation becoming too loose that lets off criminals and terrorists and has no value for lives of the common law abiding citizens ? Should those who murder people be hanged or not ? Should those who kill little children for ransom be hanged to death or not ? According to newspaper reports 36 Sikhs were killed in Chattisinghpora in district Anantnag in March 2000 and even if the killers of such massacre are killed but the master minds of such crimes may still be alive in Pakistan . If they are caught say hypothetically , then should they be given death penalty or not ? Injustices have happened in India . For example we all know mughal king Akber killed many thousands of hapless women and children in Chitor after he defeated Rajputs there . This is well documented and even Akbar's own man Abul Fazal has taken pains to justify that massacre of hapless women and children . Some people say many thousands of Rajputs were killed after that battle of Chitor fort , other people say that all Rajputs died while fighting and those hapless women and children belonged to simple peasants , farmers and shudras etc . Killing in battle was alright but killing hapless women and children after the battle cannot be exonerated . The only solace in this case is that KARMA THEORY would have applied to the perpetrators of this injustice and those soldiers who killed hapless women and children would have burned in fire of hell . If timeline permits then should those soldiers be given death penalty or not ? We all know about the infamous Nirbhaya rape case in Delhi where the biggest criminal was a Juvenile and there was an uproar in India for amending the Juvenile act so that the criminals committing heinous crimes like rape or murder do not escape punishment . Should the criminal even if he is a juvenile be hanged to death in this case or not ? A so called juvenile in the age group of 17 - 18 years who commits murder or brutal rape does not deserve to called a juvenile and should be given death penalty in my personal view . There is another case in Jammu where two shameless persons namely Gagandeep Singh and Darvinder Pal Singh belonging to Sikh community kidnapped a little child and murdered him for ransom . Later these shameless creatures were caught by police and as per newspaper reports they confessed to their crime . Recently I read in newspapers that these two people are released just because they are Juveniles . My question is that by releasing such criminals are we not setting a bad example ? Criminals are just criminals and in my view those criminals who kill innocent people and innocent children should be hanged to death . Of course they will burn in the fire of hell also . Whether we believe it or not the karma theory is very strong and anyone who does crime of killing people , raping women , taking someone else's money and not returning it etc should be sure that he will burn in fire of hell even if he escapes punishment in this mortal world . In this particular case the child was very small and I want to ask whether that murdered child will ever get justice and those who murdered him will get hanged to death ? I also request for amending Juvenile act retrospectively so that those who commit heinous crimes cannot escape punishment . It is also requested that the age certificates of such criminals should be thoroughly checked . In the cases mentioned above the criminals should be given toughest punishments . Our society cannot be a loose society that lets off criminals of any community or religion . In my personal view criminals and terrorists have no caste or religion and thus should be given tough punishments . Further I want to hypothetically ask Robert Badinter that God forbid if she or someone close to her ever have to pass through bad encounter with criminals bent on murder or rape and later it is found that those criminals get out of jail just because India has abolished death penalty , then what would she feel ? Or if those criminals happen to be juveniles in age group of 17-18 years and escape punishment then what would she feel ? That is why India should retain death penalty so that those who commit crimes of rape and murder should get hanged to death .
I also want to hypothetically ask Madam Tara Rao of Amnesty international India that if she God forbid has to face ugly situation of rape , muder etc and later she finds that the perpetrators of such crime escape death penalty then how will she feel ? It is thus clear that death penalty should be there at least in our modern democratic India where there is robust judicial process . Death penalty can be abolished in non democratic countries where there is possibility of misuse of death penalty . On a lighter note if there is no death penalty and the criminals and terrorists are put in jail , then why should the Indian citizens pay for the maintenance of such criminals in jails ?
