DB restrains construction on Agriculture land
PIL regarding conversion of Basmati rice growing Land

Jammu, Dec 11 : In a Public Interest Litigation filed by Ranjeet Singh Chib in which petitioner shown his concern for illegal conversion of world famous Basmati Paddy/Rice Land Growing into concrete jungle with free hand in Sub Division RS Pura.
As per PIL petitioner submitted that thousands of Kanals of land has been converted into banquet halls, residential colonies and business complex in last five years without obtaining permission from the Revenue Minister as required under J&K Land Revenue Act, A Division Bench of state High Court Comprising Chief Justice MM Kumar and Justice Tashi Rabstan today restrained construction on Agriculture land.Today when this PIL came-up for hearing, Division Bench observed that this matter pertains to conversion of agricultural land into residential area. The agricultural land is known for growing of special species of Basmati rice and further observed that this Court while issuing notice on 11.09.2014 has directed respondents shall constitute a committee headed by an officer not below the rank of Assistant Commissioner to make survey of the area i.e., Sub District R.S.Pura and submit report regarding actual area of agricultural land within Sub-District, R. S. Pura converted to non-agricultural use i.e., construction of residential houses, housing colonies and commercial complexes.
The Committee shall submit its report by or before next date of hearing with an advance copy to learned counsel for the petitioner and also directed The Building Operations Controlling Authority and all other officers/authorized conferred power and jurisdiction under the Jammu and Kashmir Control of Building Operations Act, 1988 not to grant any such permission to the construction proposed to be raised on agricultural land in Sub District, R. S. Pura unless change of land use is permitted by the Competent Authority.
When Division Bench asked AAG HA Siddiqui that how conversion of agricultural land to non-agricultural purpose at such a large scale has taken place, he conceded that it was obviously without any permission under Section 133-A of the Land Revenue Act.(JNF)
