DB directs JMC, JDA to take action against fresh construction violators
PIL regarding violation of Master Plan

Jammu, Dec 11 : In a letter written by Amit Dalia, a social activist regarding constructions of illegal buildings in the Jammu City which include the Master Plan Violations which was treated as Public Interest Litigation, A Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Tashi Rabstan after hearing battery of lawyers observed that Advocates Parag Sharma and Sr. Adv R.K.Gupta Amicus have pointed out large scale violations in the use of residential area particularly in Gandhi Nagar.
Advocate S.S.Nanda has filed a list of cases pending in various Courts pointing out that interim directions have been issued by the Courts. Likewise, JDA has also filed a list highlighting the violations. These violations involve use of residential areas into the commercial area without seeking any permission from the local bodies. As a resultant effect, the residents of the areas are unable to live in peace and tranquility, they face parking problems and the area is unnecessarily congested.
Division Bench further observed that the interim orders passed by any other courts should not come in the way of JDA or Municipal Corporation, Jammu to proceed with action with regard to razing of fresh construction which might be in progress. JDA and Municipal Corporation shall be entitled to seal the buildings if such a fresh construction is found to be in progress on the spot. If there is any obstruction in discharging of their official duties, then IGP Jammu is directed to provide them police help. (JNF)
