Shiv Sena and its challenge to PM Narendra Modi
Start land acquisition from J&K
5/1/2015 10:40:46 PM

Early Times Report
JAMMU, May 1: war of words and fight on ideological issues between the BJP and its ally Shiv Sena in New Delhi and Maharashtra has taken a new twist. The Shiv Sena, which is opposed to the BJP’s Land Acquisition Bill that has angered the farmers across the country and united the entire opposition against the BJP, has dared Prime Minister Narendra Modi to start land acquisition from Jammu & Kashmir if it really meant business.
The Shiv Sena on Thursday said that BJP-led NDA Government at the Centre had made the bill a prestige issue and that while it can take away land from farmers elsewhere in the country ignoring their pleas, it cannot show the "same courage" in Jammu and Kashmir due to Article 370. The Shiv Sena took this right stand after the Modi Government made it clear in Parliament that its pet Bill, the Land Acquisition Bill, will be applicable all over the country except Jammu and Kashmir.
The Shiv Sena actually exposed the BJP’s dual approach and questioned its very stand on Jammu and Kashmir State. In other words, the Shiv Sena asked the BJP to clear its stand on Jammu and Kashmir by questioning the very applicability of the Land Acquisition Act, if passed by the Parliament, in the country, barring its Jammu and Kashmir.
It would be only proper to say that the Shiv Sena accused the BJP in its mouthpieceSaamana of not considering Jammu and Kashmir an integral part of India and the people of the state, especially Muslims of Kashmir, a race apart. To be more precise, the Shiv Sena mouthpiece treated the BJP at par with the Congress, which never considered Jammu and Kashmir an integral part of India to the same extent as other states of the Union and drove the state away from the national mainstream or created an unjust and invidious distinction between Jammu and Kashmir and other states of the Union by incorporating the communal and separatist Article 370 in the Indian Constitution in October 1949 that grants separate status to the solitary State of Jammu and Kashmir.
What did Saamana say while daring the BJP to start acquisition of land from Jammu and Kashmir? It said that "while the (BJP-led) government gave this information, its chest might have swelled with pride but for the people of this country it has sunk after hearing this" and that “Jammu and Kashmir needs development the most but Article 370 of the Constitution prevents any development from taking place in the region”. "The (BJP-led) government's fight to get the Land Acquisition Bill cleared is a prestige issue now. But development of roads, hospitals, industries, is needed the most in Jammu Kashmir. But, according to Article 370 of the Constitution, nobody from outside the state can even buy an inch of land there," the Saamana said in its editorial. "This shows that the government cannot show the same courage in Jammu and Kashmir as it is showing to usurp land for the Jaitapur nuclear power project in Maharashtra and that it can only take away lands of farmers turning a deaf ear to their pleas," it said. "If you want to start Land Acquisition, start it from Jammu and Kashmir. But the government pleads helplessness then. It shows that even if the state is on the map of India, the country's laws are not applicable there," it also said.
It needs to be underlined that while abrogation of Article 370 was one of the core issues for BJP, it was sidelined by it on the eve of the 2014 assembly elections just to appease the votaries of this Article, including Hina Bhat, who joined the BJP almost at the same time and threatened that she, like other Kashmiri people, will pick up the gun if her party tinkered with this Article.
Will the BJP accept the Shiv Sena’s challenge by starting acquisition of land from Jammu and Kashmir? The answer seems to be no considering the manner it has been behaving since September 2014. It’s not that BJP the people of Jammu and Kashmir or for that matter of the country as a whole, used to take it. It is an altogether a different party that, according to the nationalists, is ‘worse” than the Congress and a party which can stoop low to any extent for a few loaves and fishes of office.
