HC directs Kashmir Div Com to file response

Jammu, July 22: In a PIL filed by advocate Parimoksh Seth in which he submits that inspite of the fact that penal provisions of RPC make slaughtering or killing of bovine animals an offence punishable u/s 298-A and even when possession of such slaughtered animal, an act punishable u/s 298-B of the RPC, yet slaughtering and sale of such slaughtered animals is rampant in some parts of the state of Jammu and Kashmir and it is also stated that this goes on with the active connivance of the authorities who are otherwise supposed to check this practice, which severely affects the religious sentiments of a section of the society in which Division Bench directed Divisional Commissioners of Jammu and Kashmir to file a report as to the steps that have been taken with a view to prevent either slaughtering or sale of such slaughtered animals in various areas falling under their jurisdiction also directed Divisional Commissioners shall obtain inputs from Inspector General of Police Jammu as well as Kashmir range, to find out as to whether the activities of slaughtering of bovine animals and their sale is being undertaken on commercial level on regular basis and if so, what steps have been taken by them with a view to brining the guilty to book.
A high court division bench of Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal after hearing the two sides, observed that vide order dated 04.08.2014, this court had directed the divisional commissioners of Kashmir and Jammu to submit a report as regards the steps taken to prevent either slaughtering or sale of such slaughtered animals in various areas falling under their jurisdiction. It was also ordered that these authorities would obtain inputs from IGPs of Jammu as well as Kashmir ranges as to whether there was any organized activity of slaughtering and sale of such bovine animals on a commercial/regular basis.
Counsel for the petitioner submitted that there was rampant smuggling of bovine animals into the state especially in Kashmir Valley for purposes of slaughtering and subsequently their sale. He submitted that it was a common knowledge that on slaughtering of the bovine animals, they were being sold openly in certain areas of the city of Srinagar, not to talk about its sale in various smaller towns in the valley.
HC took serious note of it and observed that despite various orders issued in this regard by this court, the divisional commissioner, Kashmir, has failed to file his response. Since the matter is of a sensitive nature and hurts the sentiments of certain sections of the society besides being cognizable offence, the authorities concerned were required to act immediately especially after the orders passed by this court.
HC allowed four weeks time on the request of the AAG appearing for the respondents after he submitted that he shall positively file an appropriate response in this regard. HC observed that it is made clear that in case the response on behalf of Divisional Commissioner, Kashmir is not filed within a period of four weeks, cost shall be imposed on him which shall be paid from his own pocket.
HC also directed DGP to ensure that appropriate action be taken against those involved in offence punishable under Section 298-A of RPC.(JNF)
