HC acts tough on tuck shop diploma holders, stays FMPHW selection list for Kishtwar

Kishtwar, Aug 26: Acting tough on the candidates having tuck shop diplomas and were appointed in various government department at the cost of the genuine candidates, the Jammu and Kashmir High Court bench headed by Justice Janak Raj Kotwal stayed the selection list of Female Multi Purpose Health Workers for district Kishtwar under National Rural Health Mission issued by Chief Medical Officer Kishtwar (Vice Chairman NRHM) vide No. CMO/K/NRHM/523-30 dated 17-08-2015 on the grounds that the diplomas/certificates produced in FMPHW on the basis whereof they have been found eligible for appointment to the said post are said to have issued by an institute located in the state of Karnataka while in actual as per communication No SPMC/GMC/SGR/1035-36 dated 31-01-2015 issued by the J&K State Paramedical Council, Government Medical College Srinagar J&K, the state Para Medical Council has not recognized any Para-Medical Institute outside the state till date.
As per the details available with "Early Times", in a petition filled by Arti Thakur D/O Munshi Ram Thakur R/O Lopara Dachhan, Asha Devi D/O Roshan Lal R/o Lopara Dachhan, Priyanka Thakur D/O Devi Dass R/O Sounder and Kosar Parveen D/O Ghulam Ali Shah R/O Changer Marwah vide SWP No 2368/2015 and MP 1/2015 pledge in the court that the selection list issued by the CMO Kishtwar in advertisement No 01/2015 Dated 18-02-2015 is assailed many only ground that the diplomas produce by the selected candidates were issued by a Karnataka based Sai Paramedical Institute, while in reality the students having diplomas/certificates of the said institute never visited there and instead procured these diplomas/certificates while sitting at home and claimed that the diplomas/certificates with high percentage marks are fake and invalid as the said institute was not authorized to issue any diplomas/certificates through any institute existing in state of Jammu and Kashmir.
Upon hearing the counsel for petitioners, Justice Kotwal observed that the prima facie case of indulgence by this court is made out and issued notice to the respondent through Commissioner Secretary Health, Civil Secretariat Srinagar, Deputy Commissioner Kishtwar, CMO Kishtwar, Mission Director NRHM, Director Health Services Jammu, J&K Paramedical Council through its president Principal GMC Jammu, controller of examination, Jammu Division J&K State Paramedical Council and the selected candidates returnable within four weeks’ time. Justice Kotwal besides staying the selection list of FMPHW also ordered that as an interim order, subjected to objections and till next date before the bench, selection and appointment of private respondents (selected candidates) shall stay and they shall be deemed not to have been appointed and fixed the next date of hearing on 22-09-2015.
While talking to "Early Times" many candidates rued the selection process added that other candidates have also decided to move the court in next few days.
"How the selection process could be trusted where the husband as well as the brother of a selected candidate was performing their duties as supervisors during screen test examination" said a drop out candidate wishing anonymity. He said that despite number of representations given to concerned officers highlighting the loopholes that had put the question mark on the selection process, all the genuine concern of the applicants were ignored at the cost of the blue eyed persons having full political backing of ruling party representatives.
"Just scrutinize the list of selected candidates--- it will clearly show that the selection is made under the political influence and to appease the political bosses while genuine candidates had been left aside" alleged non selected candidates, who had also decided to move the court.
It is pertinent to mention that "Early Times", have highlighted the alleged issue of sale of tuck shop diplomas through unregistered Apex Paramedical Institute Doda and Asrariya Paramedical and Research Institute Kishtwar to students. ACR Kishtwar on the direction of DC Kishtwar has also initiated inquiry in the case which is still under progress.
