KPS cadre issue: Govt admits disparity with senior police officers, assures justice

SRINAGAR, Oct 12: Two days after Early Times reported about the disappointment of senior police officers of Kashmir Police Services (KPS), particularly those of 1999 batch who are waiting for their promotion for many years, the issue of non-caderization of KPS officers on Monday rocked the Legislative Council.
A ruling party MLC accused the "IAS and IPS lobby" of hoodwinking the promotion process by sitting on the files. He said that due to delay in KPS caderization, there is mistrust among the police officers who are waiting for promotions to next rank.
"The irony is that despite the fact that KAS and KPS officers are recruited through a common exam conducted by the Public Service Commission, the KAS has a cadre of its own while KPS officers are without any cadre and the issue has been neglected by successive Governments," the MLC said.
Replying to the written question of the MLC, Minister for Horticulture, Hajj and Auqaf, Abdul Rehman Veeri, who spoke on behalf of the Chief Minister, said the Government has issued SRO 386 of 2008 formulating J&K Administrative Rules to govern services of KAS officers directly recruited by PSC or promoted from various feeding cadre.
Veeri said the JKP (Gazetted) Service Recruitment Rules have already been notified. He said that in terms of Rule 3 of the said rules, the Jammu and Kashmir Police (Gazetted) Service has been constituted and members of the service were notified.
The Minister said the PHQ has submitted a proposal to the Home Department for carving out pay scales including Junior Scale, Time Scale, Selection Grade, Special Scale, Super Time Scale and earmarking of posts at various levels on pattern of the J&K Administrative Services. He said the proposal is under examination in the Home Department, however no time frame could be indicated at this stage.
The Minister agreed in principal that there is disparity with the KPS officers of all batches who fail to get promotion.
"I can say many officers among them are dynamic officers who played key role in bringing peace within the State, and there is disparity with them. I even talked about this disparity and injustice to KPS officers with the Chief Minister. I can assure you that our Government will look into it," said Veeri.
As reported by Early Times in its October 10 edition, the Government vide SRO 549 Dated 19-10-1984 promulgated J&K Police Gazettted Service recruitment rules which provide that while all the senior duty posts in the cadre strength of IPS of J&K will be manned by IPS officers, the KPS officers without their induction into IPS shall get elevated up to the rank of DGP on ex-cadre basis and for which some posts were earmarked. But to the disappointment of the local police officers, these rules were kept in abeyance vide SRO-166 dated April 22, 1985.
The proposal of setting up of KPS cadre like that of already existing KAS cadre on the lines of State police cadre in other States like Punjab and Himachal, has already been sent to Home department. The service rules don't permit police officer to form an association or union to push their demands.
The setting up of KPS cadre shall benefit all the Gazetted State police officers from the rank of Dy SP to SSP which include KPS batches of 1999, 2001, 2004, 2008, 2011, 2012, 2013. There are about 500 gazetted police officers who comprise 80% of the police officers of J&K.
