Power hungry BJP raises hands to stay in power, adjusts humiliated Seth in BCCI
The beef Issue
10/13/2015 11:47:24 PM
Early Times Report
Jammu, Oct 13: That the BJP was a party to the decision on unceremonious dismissal of Additional Advocate General, Jammu, Vishal Sharma, and Deputy Advocate General, Jammu, Parimoksh Seth, was what the people of Jammu province by and large believed in and repeatedly said so through statements and press conferences. Sharma and Seth were fired by the PDP-BJP coalition Government on September 15 from their respective positions - a decision that was widely welcomed in Kashmir. Their crime was that both the law officers defended Sections 298 A, B, C and D of the Ranbir Penal Code (RPC), which bans slaughter of bovine animals, including cow, sale of beef and consumption of beef and provide for 10-year imprisonment for those found guilty of cow slaughter. They defended these laws to the best of their ability and the Jammu Bench of the State High Court directed the police authorities on September 8 to strictly enforce these laws so that the sanctity of the RPC was maintained and cows were protected. The ruling coalition fired these law officers, RSS-BJP activists and sons of Sangh Parivar leaders - Leela Karan Sharma and Omkar Seth - without mentioning any reason, but everyone in the State knew that they were shunted out and humiliated because they, according to credible official sources, "failed to present the official view on the beef issue". In other words, they didn't fight the case in the manner that should have resulted in the revocation of the laws regarding cow killing and beef eating. It is a different story that no court could declare any duly enacted law as ultra vires unless it is considered an attack on the basic structure of the constitution.
The removal of Sharma and Seth had created a serious situation in Jammu with the critics of the BJP lambasting it and charging it with compromising its ideology to remain in power. The BJP leadership and Ministers, including Deputy Chief Minister Nirmal Singh, sought to divert the people's attention away from the issue by claiming that the PDP-controlled Law Ministry didn't take the party into confidence. The Deputy Chief Minister reassured the public that no one would be allowed to take the law of the land into his/her hand and that they had told the Chief Minister that the removal of Sharma and Seth was unwarranted and that they should be taken back.
There were reports that many in the BJP were unhappy with the party's top leadership and that they wanted the party to raise the pitch on the issue so that Sharma and Seth were taken back. It was at that juncture that BJP national general secretary and one of chief draftsman of the roundly condemned agenda of alliance, Ram Madhav, and senior RSS functionary Arun Kumar visited Jammu to tell the BJP to maintain calm and not to make any controversial statement on the issue which could destabilize the coalition Government. They were successful. After their visit, no BJP leader of any standing, no BJP Minister, no BJP MP or MLA or MLC spoke on the issue. Not just this, none of the BJP lawmakers raised the issue of removal of Sharma and Seth in the just-concluded stormy session of the State Legislature, thus establishing that the BJP was with the Kashmiri leadership as far as its attitude towards Sections 298 A to D and removal of Sharma and Seth was concerned.
And that the BJP never wanted the re-induction of Sharma and Seth in the team of Government counsels fearing a backlash in Kashmir became more than clear the other day, when Seth was appointed as standing counsel Board of Control for Cricket in India (BCCI). He would be the BCCI counsel in Jammu & Kashmir. The very fact that Seth has been appointed as standing counsel of the BCCI in Jammu & Kashmir should expose the BJP's duplicity and its politics of appeasement. Indeed, the BJP is more dangerous for the Hindu community than any other political party. It must be noted that while the BJP has been raking up the beef issue to capture Bihar, it has been directly and indirectly endorsing the stand of those who want Sections 298 A, B, C and D to be scrapped.
