Jhelum encroachments: DB serves 'show cause' notices to ‘engineers’ posted since 1996

Srinagar, Nov 27: A Division Bench of the J&K High Court comprising Justices M H Attar and Justice A M Magrey issued notices to engineers who were responsible for maintaining and preserving River Jhelum from 1996 and asked them to show cause why they should not deposit Rs 5 Crore to 10 Lakh to be ultimately used for the restoration of the water body.
Hearing a Public Interest Litigation (PIL), the division bench asked Director Information to issue the notice in two dailies for information of the engineers whose details has been given by the incumbent chief engineer in compliance to its directions in October this year. The amount asked to be deposited depends on hierarchy.
"Each Chief Engineer whose particulars are given in the notice to show cause why he shall not be directed to deposit Rs 5 Crores with the State treasury," the court said.
Similarly, each Superintending Engineer has been asked to 'show cause' why he shall not be asked to deposit Rs three crore, executive engineer Rs two crore, Assistant Executive Engineer Rs one crore and junior engineer Rs 10 lakhs.
"It shall be made clear in the public notice that in case response to the show cause notice is not filed then appropriate orders will follow," the Division Bench said, adding if ultimately order for recovery is made, then the entire amount will be spend for preserving and protecting the river Jhelum. "The engineers have been asked to file the replies by or before December 21, it added.
"The necessity of seeking particulars of all these engineers, who remained posted at one or other point of time in the areas through which the river Jhelum passes, arose because it has come on record that river Jhelum has been unabashedly encroached upon throughout its course."
The encroachments would not have taken place had these authorities discharged their duties in accordance with rules, the Division Bench said. IT also said, "All deputy commissioners shall provide details of encroachment existing on the banks of river Jhelum whether in the shape of structures or standing trees and shall continue to remove encroachments from the river banks.
