Srinagar, Nov 28: The state high court has directed financial commissioner Industries & Commerce and Director Handicrafts Kashmir to show cause why they shall not be punished for committing the contempt of the court. The direction was passed by a single bench of the court comprising Justice M H Attar while hearing a petition filed by handicrafts employees for implementing the judgment passed more than five years ago regarding their insitu promotion. "In constitutional system of governance no authority is above law. Since the judgment has not been implemented and the authorities have not appeared before the court in terms of previous order, financial commissioner/secretary industries and commerce and director handicrafts Kashmir to appear in person before the court on next date of hearing," the court said and directed to list the case on December 7. "In the meantime they shall file reply to the Rule framed against them. They shall show cause as to why they shall not be punished for prima facie intentionally and deliberately violating the court judgment," the court added. The single bench also observed that like other democratic institution, the court also survives on the faith of the people. "In case people lose faith in the democratic institutions, then there will be anarchy in the society," the court said, adding, "Courts initiate the contempt proceedings to punish the people for violating the court judgments for maintaining faith of the people in the institution of judiciary, the contempt proceedings are initiated to protect and preserve the dignity and majesty of the courts and for preserving the rule of law. |
