Court acquits Patwari from corruption charges

Jammu, Nov 30: Special Judge Anticorruption Jammu A K Koul today acquitted one Shahnaz Ahmad, Patwari Halqa, Shiba, challened by the vigilance organization for demanding bribe of Rs 5000/- from the complainant following complainant resoled from his earlier version.
While acquitting the Patwari from the corruption Charges, Special Judge Anticorruption Jammu took serious note of complainant who has made a mockery of the process of law. Court ordered that separate proceedings be initiated against complainant and in the first instance he shall be put on notice to show cause as to why he shall not be prosecuted for commission of offence u/s 182/ 191 r/w 193 RPC. The next course will follow only after the complainant submits his explanation
Special Judge Anticorruption Jammu AK Koul observed that it is necessary to put on record that the complainant Sunny Sharma, has made a mockery of the process of law. Court said that the complainant has set the process of law in motion through his written complaint dated 21/07/2008 against Revenue official where through he demands an action against the accused, on the count that he committed misconduct. VOJ moved its agency, conducted a detailed investigation and finally submitted the charge sheet in the Court on 06.06.2009. The judicial process continued for more than six years and ultimately the case failed mainly because the complainant resiled from his earlier version. In unambiguous terms the complainant refuted his earlier version that accused demanded and accepted bribe from him. Court observed that the complainant has committed the offence of perjury. The complainant has mocked the entire system for some unknown gain. He has intentionally fabricated false evidence for the purpose of being used in judicial proceedings or has given false evidence during the proceedings of this case and it is high time that such witnesses are dealt with severely in order to eradicate the evil of perjury..
