Jammu, June 24 : In a petition filed by various government teachers who usually teach in private coaching institutions, challenging October 25, 2015 order No 577-DSEJ whereby tuitions by them were banned, high court vacation judge B S Walia today issued notices to education secretary and director school education (DSE), Jammu, and directed that the Supreme Court orders in this regard were not violated in any manner. The petitioners' counsel stated that the August 11, 2005 order in as much as it conferred right on government to grant permission to teachers and doctors to engage themselves by way of self employment or in the form of accepting part time employment in private coaching centres two hours before the opening of schools and two hours after their closing, was set aside by the division bench in a PIL. He submitted that Supreme Court had stayed the order of J&K high court's division bench, banning private practice by the government doctors and tuition by government teachers and this position was stated to be continuing till date. Hence the ban on private practice by teachers in coaching centers was in derogation of the Supreme Court orders, he said. Justice Walia, after hearing him, issued notices to education secretary and DSE, Jammu, and directed respondents to ensure that the orders of Supreme Court were not violated in any manner. (JNF) |
