HC directs personal appearance of PDD CE

srinagar, Oct 17: The state high court has ordered personal appearance of Chief Engineer of PDD (R&ME), Kashmir, on October 20 next over non-compliance of its orders.
Chief Justice N Paul Vasanthakumar heard the contempt petition for non-compliance of the directions issued in SWP of 1996 on January 30, 2006, whereby the petition was allowed with direction to the PDD to release the grade of Installation Inspector in favour of the petitioner from the date the job was assigned to him and necessary order in this regard was directed to be passed within a period of three months.
As government failed to comply with the court order, the petitioner filed contempt petition. During the pendency of the contempt plea, respondents implemented the order of the writ court partly inasmuch as the sanction was accorded for giving salary attached to the post of Inspector from the date of judgment.
After passing of order by the court, the order granting sanction for release of salary attached to the post from January 30, 2006 was modified by the PDD chief engineer vide his order on April 9, 2012 to the effect that the designation already accorded in favour of the petitioner was retrospectively protected with effect from March 1, 1993 instead of January 30, 2006 but without involvement of any monitory benefit or drawal of any arrears on this account. "The April 9, 2012 order of the CE is also not in tune with the order of writ court which specifically granted relief to the petitioner to get the grade pay from the date job of Installation Inspector was assigned to him," the court said, adding, "In such circumstances, the present CE PDD R&ME wing, Kashmir, is directed to appear in person on October 20, 2016 before this court along with the compliance order," the court said and made it clear that if the compliance order was not passed by the next date, the court may impost 9 pc interest to the amount payable to the petitioner and the chief engineer will not be permitted to draw his salary till the order of the court was complied with.
