Compensate Jamiat-e-Ahlehadees: High Court to Govt

Srinagar, Jan 18: The State High Court today asked government to provide compensation to an organization whose land was taken for the construction of the court complex at Moominabad here.
The petitioner- Jamiat-e-Ahlehadees, had filed the petition, seeking inter-alia directions to the government to settle the claim of the petitioner organization finally for payment of compensation on account of expenditure incurred by the organization for development of land situated at Moominabad, Batamaloo, Srinagar, promised via Government order No.40-Rev/S of 2008 dated 18.02.2008.
They also sought directions to pay the amount of compensation to the petitioner organization within the shortest period of time so that it could complete the pending projects which the organization has initiated for development of educational institution.
It claimed that the land which has been utilized for construction of District Court Complex at Moominabad, was in possession of the petitioner organization and the same was taken over by the government by extending a promise to the petitioner organization that they would be adequately compensated.
It was submitted that the organization approached the the Divisional Commissioner, Kashmir, to fulfill the promise but nothing has been done.
The counsel for the petitioner submits that the organization would feel satisfied, if the petition is disposed of at this stage, by directing the Divisional Commissioner, Kashmir, to take a decision on the pending request of the petitioner organization.
Keeping in view the submission of counsel for the petitioner and the nature of relief prayed for, the petition was disposed of by a bench of Justice Sanjeev Kumar providing that if any request with regard to the subject matter of the petition is pending consideration before the Divisional Commissioner, Kashmir, for payment of compensation to the organization, the same shall be considered on its merits and disposed of at the earliest and in any case within two months from the date a copy of this order is made available in the office of the Divisional Commissioner, Kashmir.
